As used in this chapter, the following terms shall have the meanings indicated:
TOWN HALL
Premises locally known as "8500 Boston State Road, Boston, New York."
TOWN PROPERTY
All real property owned by the Town of Boston, including all property over which the Town of Boston has a temporary or permanent easement, excepting therefrom any property rights-of-way or easements acquired or accepted for highway purposes.

Unless otherwise provided by law, regulation or agreement, the use of Town property by other than a resident of the Town of Boston is expressly prohibited, except that:
A. 
A nonresident accompanied by a resident may be admitted.
B. 
Any participant in or spectator of an organized program sponsored or supported by the Town may be admitted.
C. 
Any person attending a public meeting of the Town of Boston or any public meeting authorized by the Town Board of the Town of Boston may be admitted.
D. 
Property located at the Boston Valley Elementary School over which the Town of Boston has an easement shall be available for use by any resident of the Hamburg Central School District, as well as the Town of Boston, said property being known and designated herein as the "Boston Creative Playground."

All Town property shall be closed each night between the hours of 10:00 p.m. and sunrise the following morning, or such other time as shall be set by the Town Board, except for property in the vicinity of the Town Hall during any meeting of the Town Board or any other board or committee established by the Town Board or any other use of the Town Hall authorized by the Town Board or an official authorized by the Town Board; provided, however, that the property known as the "Boston Creative Playground" shall be closed from sunset to sunrise the following morning.
No person shall lounge about or remain on any Town property after the same has been closed.
No person, firm or corporation shall sell or offer for sale on Town property any property or privilege whatsoever unless authorized by the Town Board.
No person shall climb any tree; injure, deface, disturb or befoul any Town property or any building, sign, equipment or other property found therein; or remove, cut down, injure or destroy any tree, flower, shrub, ornament, statue, fence, bridge, structure or other property within any Town property or any other area under the control of the Town Board.
The grounds of all Town property shall be maintained in a clean and sanitary condition.
A. 
No person shall deposit, dump, throw or place any earth, rubbish, paper, bottle, bits of crockery, glass or glassware, metal or other substance, garbage or other refuse matter or any sand, stone, lumber or other material or any kind in or upon any Town property.
B. 
Garbage and refuse must be deposited in receptacles provided.
No person shall fire or discharge any gun, pistol, firearm or slingshot or any rocket or other fireworks of any description or carry or transport the same on any Town property, unless upon permission of the Town Board.
No person shall bring any dog onto any Town property unless the same is on a leash of not over six feet in length and kept on a leash while in said park, playground or recreational area.

No person shall participate in the following activities on Town property:
A. 
Game hunting.
B. 
Swimming.
C. 
Skateboarding.
No person shall use, ride or drive a horse on any Town property, excepting over bridal paths or other paths that may be established for said purposes. No rider shall travel at a gait in excess of a trot while on Town property to preserve the safety of the public and avoid endangering children at play.
No person shall bring onto any Town property or have in his possession while there any alcoholic beverages.
No vehicle shall be operated on any Town property except on designated roads or parking areas.
It shall be unlawful for any person to operate a snowmobile, motorcycle, motorbike, scooter or any similar self-propelled vehicle on any Town property unless authorized by the Town Board.
No person shall park or cause to be parked any vehicle on Town property at any time when said property is closed, except if said vehicle is parked on a paved surface in the vicinity of the Town Hall, within 150 feet of the westerly boundary of Boston State Road.
No person shall drive or cause to be driven any vehicle along or over any road within any Town property at a speed in excess of 15 miles per hour.
The operation of commercial vehicles on any Town property is expressly prohibited, except for commercial vehicles of 3/4 ton or less carrying capacity and for such other commercial vehicles serving the Town property.
By the issuance of a special permit, the Town Board may allow activities otherwise prohibited by this chapter.
Violation of any provision of this chapter is hereby declared an offense against the same and may be punishable by a fine not to exceed $250 or imprisonment not to exceed six months, or by both such fine and imprisonment for each and every offense.
