[Adopted 11-10-1997 by Ord. No. 17-1997]
Pursuant to the authority set forth above,[1] Allegheny Township is hereby authorized to join the Central Westmoreland Council of Governments and to participate in intergovernmental agreements through that organization, under the following terms and conditions:
A. 
The conditions of the agreement of membership, as set forth in the bylaws and other organizational documents of the Central Westmoreland Council of Governments, are hereby adopted, ratified and confirmed, to the extent that said conditions are not otherwise inconsistent with any ordinance, resolution or policy of this Township or otherwise prohibited by law. This Township Board of Supervisors, or its duly appointed representative or representatives, shall have the authority to reject any action or agreement of the said Central Westmoreland Council of Governments which is inconsistent therewith.
B. 
This Township's participation or membership in the Central Westmoreland Council of Governments shall be for one year, and shall be renewable each year, by a duly adopted resolution of this Board, except that nothing herein contained shall be interpreted as precluding the Allegheny Township Board of Supervisors from withdrawing or terminating its membership in the Central Westmoreland Council of Governments sooner, if said withdrawal or termination is determined to be in the best interest of the Township;
C. 
The purposes of and objectives for this Township's participation and membership in the Central Westmoreland Council of Governments is as set forth in the above recitals, which are incorporated herein; in Act 180, as cited above; and as set forth in the bylaws and other organizational documents of the entity. In addition, the purpose of and objective for participation and membership is to provide a medium for more efficient performance of governmental functions and delivery of certain municipal services and a forum for discussion of same.
D. 
Allegheny Township Board of Supervisors is hereby authorized, following a resolution duly adopted, to pay annual membership fees in and to the Central Westmoreland Council of Governments, as well as to expend such other funds as may be authorized by law, or as may be approved by this Council, as necessary to carry out the functions and purposes of any intergovernmental agreement or membership in said entity.
E. 
The structure of the Central Westmoreland Council of Governments, as set forth in its bylaws and other organizational documents, is hereby ratified and confirmed. This Township Board of Supervisors shall appoint annually such delegate, delegate(s) or alternates to the governing body of said entity to assure adequate representation of the Township therein.
F. 
To the extent that it has the capacity or obligation to control, all property, real or personal, which shall be acquired by the Central Westmoreland Council of Governments shall be managed or disposed of in accordance with that entity's bylaws or other organizational documents, or as may be required by law. No transaction which affects this municipality shall be deemed to be binding thereon unless approved or ratified by the Board of Supervisors or approved, per authorization, by this Township's representatives to the organization. Under no circumstances shall any such transaction be in violation of this Township's ordinances, resolutions or policies.
G. 
This Board of Supervisors, or its representatives, is authorized to take whatever action may be necessary to secure and establish this Township's right to receive pro rata distribution of any property to which it is entitled, upon dissolution of the said Central Westmoreland Council of Governments.
H. 
This Council is hereby authorized, by resolution, to enter into any contract which is deemed to be beneficial to the residents and taxpayers of this Township, including, but not limited to, policies of group insurance and employee benefits, including social security, for any employees of the Township or of the Central Westmoreland Council of Governments.
I. 
No action taken by the Central Westmoreland Council of Governments, which creates a legal obligation upon this Township, shall be binding unless and until approved or ratified by this Board of Supervisors or approved, per authorization, by this Township's representatives to the organization. Under no circumstances shall any such transaction be in violation of this Township's ordinances, resolutions or policies.
