The Board of Supervisors of Allegheny Township has,
from time to time, adopted resolutions acknowledging the authority
of the various volunteer fire departments situate within the Township
of Allegheny to act as the official fire-fighting force for the Township.
In the course of conduct of their services as the
official fire departments for the Township of Allegheny, said fire
departments incur reasonable costs for fire-fighting materials, residential
and commercial equipment, commercial flooding services, and hazardous
abatement materials involving response to hazardous materials incidents,
environmental incidents, and safety and rescue incidents and operations,
including vehicular accidents.
The reasonable costs identified above shall be recovered
through the offices of the Township of Allegheny in order to coordinate
the collection process and allocate the proceeds thereof or may be
recovered directly by the volunteer fire company, through the Township
with the consent of the Supervisors.
Reasonable costs and expenses incurred by any individual
volunteer fire department shall be itemized to the Board of Supervisors
for all incidents occurring within each particular fire district.
Allegheny Township, or its delegate, shall issue invoices
to the appropriate insurance company of the person or persons involved
in the incident with payment on said invoices to be due within 60
days.
All proceeds received in the collection process will
be collected by a designee of each individual volunteer fire department
and deposited into that department's general fund for use by that
department.
In the event any claim is denied payment by the invoiced
insurance carrier, the Allegheny Township Board of Supervisors will
make final determination as to whether further action shall be taken
to collect the monies owed or whether the claim shall be withdrawn.
In addition to the aforementioned reasonable costs,
the Township is hereby authorized to collect any other additional
fee or charge as may be authorized by the Hazardous Material Emergency
Planning and Response Act[1] or as may be authorized by any other statute, case law,
or common law.
