It shall be unlawful for any person to expose for sale by auction any goods, wares, merchandise or articles of any description whatsoever of which he is not the bona fide owner, without first obtaining from the Chief of Police a license for carrying on the business of an auctioneer.

A. 
Any person desiring to secure such an auctioneer's license shall apply therefor in writing over his signature to the Chief of Police on forms provided by the Town. Such application shall state:
(1) 
The name and address of the applicant.
(2) 
The name and address of the person by whom employed.
(3) 
The length of service of such applicant with such employer.
(4) 
The place of residence and nature of the employment of the applicant during the last preceding year.
(5) 
The personal description of the applicant.
B. 
Such application shall be accompanied by such credentials and other evidence of good moral character as required by the Chief of Police.
C. 
Upon application a color passport photograph of the applicant must be submitted.

If the Chief of Police shall determine, after reasonable investigation, that the applicant for an auctioneer's license is of good moral character and proposes to engage in a lawful and legitimate commercial or professional enterprise, he shall then issue the license applied for, which license shall expire on the 31st day of December of the year in which such license shall have been issued. The fee for such license shall be $50.

If any person is convicted of any violation of any provision of this article, the Chief of Police shall forthwith revoke the license of such convicted person for the balance of such license year, and no new license shall be issued to that person during such year.
Each person to whom an auctioneer's license shall have been issued shall display a flag, upon which shall be the word "auctioneer" and the number of the license of the person owning such flag, whenever and wherever such person shall conduct any auction sale.
A. 
Any auctioneer, while acting on behalf of a bona fide charitable, religious, patriotic or philanthropic organization, shall be exempt from the provisions of this article, provided that there shall be filed with the Chief of Police a sworn application in writing, on a form provided for the purpose, which shall give the following information:
(1) 
The name and purpose of the organization alleged to be charitable, religious, patriotic or philanthropic.
(2) 
The names and addresses of the officers and directors or trustees of the organization.
(3) 
The period during which the auction is to be carried on.
(4) 
Whether or not any commission, fees, wages or emoluments are to be paid to the auctioneers.
B. 
Upon being satisfied that such organization, association or corporation is a bona fide charitable, religious, patriotic or philanthropic organization, the Chief of Police shall issue a permit without charge to such organization, association or corporation, authorizing any person acting on behalf of them to preside as auctioneer at any sale which such organization may have during the pendency of such permit.
Any person violating any of the provisions of this article shall, upon conviction thereof, be fined not less than $5 nor more than $100 for each offense. Every day upon which such violation shall continue shall constitute a separate offense.

In the conduct and operation of any auction, said auctioneer shall be a duly licensed auctioneer under the provisions of Chapter 403 of the Connecticut General Statutes, as amended from time to time. Said license shall be issued in accordance with the appropriate sections of the Stratford Town Code.
This article shall not be construed to conflict with the provisions of Chapter 403 of the Connecticut General Statutes and the restrictions and limitations contained therein and in Section 21-3 of said General Statutes, with relation to the sale of gold or gold-plated ware, silver or silver-plated ware, platinum ware, watches, jewelry, precious stones, cut glass or chinaware.
Any person who shall violate any provision of this article shall be fined not more than $100 for each offense, except as otherwise provided in Chapter 403 of the Connecticut General Statutes.
