Any person or persons shall not offer or expose for sale at public auction within the Village of Ballston Spa any goods, wares, merchandise or personal property of any kind without procuring a permit to do so from the Clerk. Said Clerk may grant a license for such auction upon the payment of a fee in an amount to be set forth from time to time by resolution of the Board of Trustees.

This chapter shall not apply to sales by virtue of any legal proceedings or sales conducted by residents of the Village for the proposed selling of their goods or property, nor shall this chapter apply to any person or entity located full time within the Village conducting an auction as part of their ongoing commercial business.

Any person who violates any provision of this chapter shall be punishable by a fine of not more than $250 or by imprisonment for not more than 15 days, or both.
