It should be unlawful for any person to peddle,
vend, sell, offer for sale or auction any goods, wares or merchandise
upon the streets, sidewalks or public places of the Town without having
first applied for and received a license from the Chief of Police
and approval of the Zoning Commission of the Town of Stratford. This
chapter does not apply to the sale of ice cream and other frozen desserts
from motor vehicles.
A.Â
Any person desiring to secure the license required by § 116-11 shall apply therefor in writing over his signature to the Chief of Police on forms provided by the Town, and such application shall state:
(1)Â
The name and address of the applicant.
(2)Â
The name and address of the person by whom employed.
(3)Â
The length of service of such applicant with such
employer.
(4)Â
The place of residence and nature of the employment
of the applicant during the last preceding year.
(5)Â
The nature or character of the goods, wares, merchandise
or services to be offered by the applicant.
(6)Â
The personal description of the applicant.
B.Â
The application required by Subsection A above shall be accompanied by such credentials and other evidence of good moral character and identity of the applicant as may be reasonably required by the Chief of Police.
C.Â
Said applicant shall also submit such information
as required by the Zoning Commission to determine any effect on traffic
or parking conditions, the product or products involved, the proposed
location and any potential noise, refuse or congestion problems.
If the Chief of Police shall determine after reasonable investigation that the applicant for the license required by § 116-11 is of good moral character and proposes to engage in a lawful and legitimate commercial or professional enterprise, he shall then issue the license applied for, which license shall expire on the 31st day of December of the year in which such license shall have been issued. The fee for such license shall be $10; provided, however, that in place of such license the Chief of Police may issue a special license to persons who may desire to sell novelties or toys, which license shall expire on the third day after being issued. The fee for such special license shall be $5.
All persons licensed by the Chief of Police
shall be issued a suitable badge bearing the words "licensed vendor"
or "special license," as the case may be, the number of such license
and the year for which such license is issued or, in the case of special
licenses, the date upon which such license expires. Licenses or special
licenses shall be carried at all times, and badges shall be conspicuously
exposed on the breast while the licensees are engaged in the business
for which such licenses and badges are issued.

The license issued pursuant to § 116-11 may be revoked for the balance of that license year by the Chief of Police for violations by the holder thereof of any of the ordinances of the Town of Stratford or any state or federal law.

Any person in violation any of the provisions of §§ 116-11 through 116-15 shall be fined $100 per day for each offense. Violators of this article shall have the right to file a written appeal to the Office of Citation Hearings within 15 days from the date of the imposition of the fines. Payment of fines and revocation of vendor’s license shall be stayed until the appeal has been heard and ruled on by a Citation Hearing Officer in accordance with §§ 6-1 through 6-11 of the Stratford Town Code.

A.Â
Except as otherwise provided by ordinance, it shall
be unlawful for any unlicensed or unauthorized person to vend or peddle
upon the public streets, public property, school property, or property
of the Town of Stratford from any type of motor vehicle, trailer,
cart or other mobile facility.
B.Â
Any person who violates this section shall be fined $100 per day for each offense. Violators of this article shall have the right to file a written appeal to the Office of Citation Hearings within 15 days from the date of the imposition of the fine. Payment of fines and revocation of vendor's license shall be stayed until the appeal has been heard and ruled on by a Citation Hearing Officer in accordance with §§ 6-1 through 6-11 of the Stratford Town Code.
C.Â
Authorized vendors. Nothing contained in this section shall be construed
to prohibit a properly licensed vendor from operating a mobile refreshment
stand, or vending from a specific location upon property of the Town
of Stratford, provided that:
A.Â
Exception for displays adjacent to stores. Except
for being subject to Zoning Commission approval, nothing contained
in this article shall be construed to prohibit persons having an established
place of business in the Town from using the sidewalks or areas adjacent
to their places of business for the display of their goods, wares
or merchandise, nor shall a license be required for the same.
B.Â
Exception for farmers and gardeners. Nothing contained
in this article shall be construed to require a license for sales
by farmers and gardeners of the produce of their farms and gardens
or the sale, distribution and delivery of milk, teas, coffees, spices,
groceries, meats and bakery goods.
C.Â
Exception for nonprofit organizations.
(1)Â
Except for being subject to Zoning Commission approval,
any organization, society, association or corporation desiring to
peddle or vend any articles of merchandise upon the streets, in business
buildings, by house-to-house canvass or in public places for a charitable,
religious, patriotic or philanthropic purpose shall be exempt from
the provisions of this article, provided that there is filed with
the Chief of Police a sworn application, in writing, on forms provided
for that purpose, which shall give the following information:
(a)Â
The name and purpose of the cause for which
the permit is sought.
(b)Â
The names and addresses of the officers and
directors of the organization.
(c)Â
The period during which solicitation is to be
carried on.
(d)Â
Whether or not any commission, fees or wages
are a part of such solicitation and the amount thereof.
(2)Â
Upon being satisfied that such organization, association
or corporation is a religious, charitable, patriotic or philanthropic
organization, the Chief of Police shall issue a permit without charge
to such organization, association or corporation to solicit in the
Town. Such organization, association or corporation shall furnish
all of its members, agents or representatives engaged in such solicitation
credentials, in writing, stating the name of the organization, the
name of the agent and the purpose of the solicitation.
D.Â
Exception
for operation of a mobile refreshment stand at the Birdseye Boat Launch.
Nothing contained in this section shall be construed to prohibit the
operation of a mobile refreshment stand approved by the Health Department
for the Town of Stratford at the Birdseye Boat Launch, pursuant to
a valid written agreement with the Town of Stratford, provided that:

E.Â
Exception
for operation of a mobile refreshment stand at special events. Nothing
contained in this section shall be construed to prohibit the operation
of a mobile refreshment stand at a specific location upon property
of the Town of Stratford during special events, provided that such
operator obtains all necessary permits, licenses and/or approvals
from the Police Department, Fire Department, Health Department and
any other governmental body having jurisdiction over such activity
and provided that such operator is not in breach of any conditions
thereof. The term "special event" shall include any single or multiple
day events that are located upon property of the Town of Stratford,
which includes but is not limited to, fairs, carnivals, festivals
or similar themed events which are limited to a specific location
for a specified time period.
