The smoking or burning of tobacco is a danger to health and a cause
of material annoyance and discomfort to those who are present in a confined
area. This chapter is adopted to provide reasonable protection of the health
of Town employees and of the public.
No person shall smoke at any open meeting of any agency, department
or committee of the Town of Falmouth.
No person shall smoke in any public building in the Town of Falmouth
except in an area which has specifically been designated as a smoking area.
An area may be designated as a smoking area only if no-smoking areas of sufficient
size and capacity are available to accommodate nonsmokers.
Any person aggrieved by the willful failure or refusal to comply with
any provision of this chapter may complain in writing to the head of the department
or agency occupying the area where the violation takes place. Said agency
or department head shall respond in writing within fifteen (15) days to the
complainant that (s)he has inspected the area described in the complaint and
has enforced the provisions of this chapter. Said agency or department head
shall file a copy of the original complaint and the response thereto with
the Board of Health.
The Board of Health shall promulgate such rules and regulations as may
be necessary to implement the provisions of this chapter.
Nothing in this chapter shall prohibit smoking in a completely enclosed
private office used by an individual within a public building within the Town
of Falmouth.
