As used in this chapter, the following terms
shall have the meanings indicated:
SITE
Any parcel, tract or plot of land within the Borough of Paramus
that is identified as a separate tax lot on the Tax Assessment Map
for the Borough of Paramus.
TEMPORARY STORAGE CONTAINER
A container designed for the outdoor storage of personal
property for temporary use and delivered and removed by vehicle. Temporary
storage containers shall not include cargo containers. Temporary storage
containers shall not be utilized for business or commercial purposes.
Temporary storage containers shall hereinafter be referred to as "pods."
USER
The owner, tenant or occupant of any site on which a pod
is placed.
Pods shall comply with the standards established
by this chapter together with all other applicable regulations of
the Borough. Where the requirements of any part of this chapter conflict
with any other section of the Borough Code, the provisions of this
chapter shall prevail.
Pods shall be permitted in all residential zones
subject to the following provisions:
A. Pods shall be placed only in the driveway, allotted
parking areas or on portions of property not located in the right-of-way.
No pod shall be located in any manner that obstructs sidewalks.
B. No pod shall be located within 10 feet of a property
line.
C. All pods shall be set back minimally 10 feet from
principal buildings.
D. All pods shall be located in such a manner as to utilize
existing buffers for the purpose of screening pods from adjoining
properties.
E. Pods shall not be located so as to obstruct vehicle
circulation, particularly emergency vehicle circulation.
F. Pods shall not be larger than 150 square feet in area.
G. Pods shall not be higher than 10 feet from grade.
H. Pods shall only be used by the owner or occupant of
the property on which the pods are placed. Pods shall be used only
to store household items and shall not be used for any commercial
purpose whatsoever, nor for the storage of any items used for business
purposes by any owner/occupant.
I. Pods shall not be used for the storage of any hazardous
substance, including but not limited to chemical, flammable or explosive
materials. Pods shall also not be used for the storage of trash.
J. Pods shall not be used for temporary habitation of
humans or animals.
There shall be no lighting fixtures attached
to any pod nor shall there be any lighting fixtures utilized to light
the interior of a pod.
All pods shall be maintained in good condition,
free from evidence of deterioration, weathering, discoloration, rust,
ripping, tearing, or other unsightly condition. All pods must be locked
when not being used by a user.
