The words, terms or phrases listed below, for the purpose of this article, shall be defined and interpreted as follows:
PRIVATE SWIMMING POOL
Any body of water, tank or receptacle for water, whether artificially or semiartificially constructed or portable, having a depth at any point greater than one foot, used or intended to be used for swimming or bathing solely by the owner, his family and guests of the household and constructed, installed, established or maintained inside or outside any building in or above the ground, upon any premises, as an accessory use to the residence.
WADING POOL
Any artificially constructed pool not designed or used for swimming, with a maximum depth of one foot, whether permanent or portable.
It shall be unlawful for any person to construct, install, establish or maintain a private swimming pool or wading pool, as herein defined, without having obtained a permit therefor, in the manner prescribed in § 355-3 herein. However, no permit shall be required for a wading pool of the portable type with a depth of one foot or less.
A. 
Application for a permit to construct, establish or maintain or to alter, remodel or add to a permanent private swimming pool or permanent wading pool shall be made to the Building Inspector by the owner of the property or by the contractor who will construct the same. The application shall be accompanied by four sets of:
(1) 
A plot plan showing property lines of the premises, all existing houses and structures thereon and the location and dimensions of the proposed private swimming pool or wading pool and its auxiliary structures and all existing fences or walls and the height thereof; and
(2) 
Plans and specifications for the proposed private swimming pool or wading pool and all auxiliary structures and appurtenances related thereto and the location, height and aperture dimensions of the fence, together with the gate and its locking or latching devices, which is to be erected when such fencing is required under this article.
B. 
Application for a permit to install, establish and maintain a portable private swimming pool or portable wading pool shall be made to the Building Inspector by the owner of the property or by the person who will install the same. The application shall show the dimensions of said pool and the system and place of discharge of the water.
No permit for a private swimming pool or wading pool shall be issued by the Building Inspector until the plans, specifications and plot plans have been approved by the Health Officer and the Plumbing Inspector of the Borough and such approval has been properly certified on the plans.
A. 
A fee of $10 shall be paid to the Borough of Ridgefield for a permanent private swimming pool permit, which permit fee shall be exclusive of the permit fee required for erection of any accessory structures to be used in connection with such private swimming pool.
B. 
A fee of $5 shall be paid to the Borough of Ridgefield for a permit for a portable swimming pool in excess of 2,500 gallons maximum, or approximately three feet high by 12 feet in diameter.
C. 
A fee of $2 shall be paid to the Borough of Ridgefield for a permit for a portable swimming pool or wading pool from 2,500 gallons or three feet high by 12 feet (inclusive) down to one foot in height.
D. 
No fee shall be charged for small portable pools of one foot and under, inclusive.
E. 
The above permit fees shall be payable annually on the first day of May to the Ridgefield Board of Health.

A. 
All material used in the construction of private swimming pools and wading pools as herein defined shall be waterproof and easily cleaned. Construction and design of said pools shall be such that they may be maintained and operated as to be clean and sanitary at all times. The owner of every private swimming pool and wading pool shall be responsible to maintain said pool in such condition as to prevent breaks in the pool chassis or water from the pool overflowing onto adjacent property.
B. 
The noise generated by the pumps and filters servicing the pool shall be in conformity with the provisions of Chapter 275, Noise, of the Code of the Borough of Ridgefield.

C. 
All areas surrounding the pool shall be made and kept neat and attractive so as to be in conformity with surrounding property, and no rubbish, debris or litter shall be permitted to remain or accumulate in or about the pool.
D. 
All operating equipment used in connection with maintenance of a pool, such as filtration pumps, heating units and/or electrical auxiliary equipment, shall be housed in a soundproof structure designed to effectively reduce any sounds generated thereby and located in the rear of property conforming to rear yard setbacks of 16 feet and side yard setbacks of seven feet to eight feet.
E. 
All outdoor pools may be used during reasonable hours during the mornings, afternoons and evenings, said hours being 9:00 a.m. to 10:00 p.m.
F. 
Owners of corner lots shall provide for a landscape buffer between their pool and the adjacent property.
There shall be no physical connection between a potable public or private water supply system and such private swimming pools or wading pools at a point below the maximum waterline of the pool or to a recirculating or heating system of said pool. An air gap of four inches will be required above the rim of the pool to the water-supply pipe.

All private swimming pools or wading pools with a water depth of more than one foot, hereafter constructed, installed, established or maintained within the Borough of Ridgefield, shall be provided with one drainage outlet not in excess of three inches in diameter extending from said pool to either a storm sewer or lawn sprinkling system on the premises on which said private pool or wading pool is located. The discharge of water from such private swimming pools or wading pools into a storm sewer shall be permitted only following approval by the proper state, county and Borough officials, as each case requires. No private pool drain or wading pool drain shall be connected into the sanitary sewer system except upon written approval of the Health Officer and Plumbing Inspector and Director of Public Works. Application for approval shall be in writing. The Building Inspector or such employees as shall be designated by the Borough Council shall inspect the premises on which such pool is planned to be constructed, installed, established or maintained, in order to determine the proper place and type of connection with the sanitary sewerage system, if such connection is authorized by the Borough. Approval of an application shall not be given if it is feasible to discharge water from a pool into a storm sewer or use such water for purposes of lawn sprinkling on said premises. Approval shall not be given to discharge such water at the curb or upon the surface of any street.

Where approval is obtained to discharge water from a private swimming pool or wading pool into the sanitary sewerage system, the owner, lessee or occupant of said pool may discharge the water only at the time or times designated and allocated by the Health Officer and Director of Public Works and endorsed on the permit. The purpose of this requirement is to prevent a strain upon the sewerage system by controlling and distributing the discharge of water.
All private swimming pools and wading pools shall be treated with chlorine or its compounds in sufficient quantity so that there will be present in the water, at all times when the pool is in use, a residual of excess chlorine of not less than 0.4 nor more than 0.6 part per million of available free chlorine.
Not more than 15% of the samples of water taken from any private swimming pool or wading pool when more than 20 samples have been examined, and not more than three samples when less than 20 samples have been examined, shall contain more than 200 bacteria per cubic centimeter or shall show positive test (confirmed) for coliform in any five ten-cubic-centimeter portions of water at times when the pool is ready for use. For the purpose of this section, any number of samplings of water, on a single day, shall be considered as one sample. The local Board of Health is hereby authorized to take samples to insure compliance with these requirements.
Locker rooms, bathhouses, cabanas, shower rooms, toilets, runways and all other physical facilities or equipment incident to the operation of any private swimming pool or wading pool shall be kept in a sanitary condition at all times.

No private swimming pool or wading pool with a capacity of more than 250 gallons and no accessory building as set forth in § 355-12 hereof shall be constructed, erected, installed or maintained within seven feet of any property line nor within 10 feet of any residential structure, either on or off the premises, nor shall any such pool be constructed, erected, installed or maintained in the front yard of the property. Side yard installation shall not be less than seven feet inside the established building line.
A. 
All permanent private swimming pools and all permanent wading pools shall be completely surrounded by a fence or wall of the type and dimensions hereinafter specified.
B. 
All portable private swimming pools and portable wading pools, unless enclosed by a fence or wall of the type and dimensions hereinafter specified, shall be either:
(1) 
Emptied when not in use or unattended; or
(2) 
Covered with a suitable, strong protective covering, securely fastened or locked in place, when not in use or unattended.
C. 
Whenever a fence or wall is required to be erected under this article, it shall be at least four and no more than six feet in height and shall be so constructed as not to have openings, holes or gaps larger than four inches in any dimension, except for doors or gates, and if a picket fence is erected or maintained, the horizontal dimension shall not exceed four inches. A dwelling house or accessory building may be used as part of such enclosure. All gates used in conjunction with the fence or wall shall meet the same specifications as the fence or wall itself and shall be equipped with approved self-closing, locking and latching devices and shall be locked at all times when the private swimming pool or wading pool is not in use. This provision relates to the fencing surrounding the pool and shall not be interpreted as permitting a six-foot fence around the total perimeter of a lot. The finished side of the fence shall be placed on the outside facing neighbors' properties.

No artificial lighting shall be maintained or operated in connection with private swimming pools or wading pools in such a manner as to be a nuisance or an annoyance to neighboring properties.
A. 
Every private swimming pool or wading pool constructed, installed, established or maintained, or to be constructed, installed, established or maintained, in the Borough of Ridgefield, shall at all times comply with the requirements of the local Board of Health. Any nuisance or hazard to health which may exist or develop in, or in consequence of or in connection with, any such private swimming pool or wading pool, shall be abated and removed by the owner, lessee or occupant of the premises on which said pool is located within 10 days of receipt of notice from the Building Inspector or Health Officer of the Borough of Ridgefield. Whenever a clear emergency exists, in the opinion of the inspecting officer, he may direct that the pool be emptied immediately or any other precautions taken which he deems necessary.
B. 
It shall be the duty of the Building Inspector and the Health Officer, respectively, to enforce the provisions of this article.
C. 
The owner or operator of any pool within the Borough shall allow said Building Inspector and the Health Officer, or other authorized official, access to any private swimming pool and wading pool and appurtenances for the purpose of inspection to ascertain compliance with this article and all other pertinent Borough ordinances, at all reasonable times.

A. 
If this article of the Code of the Borough of Ridgefield provides for the licensing or permitting of the violator, the Mayor and Council of the Borough of Ridgefield reserve the right to revoke such permit or license.
B. 
Any person found guilty of violating this article of the Code of the Borough of Ridgefield shall be subject to a penalty consisting of a fine or imprisonment, or both, subject to the discretion of the Judge, the maximum of which shall be the maximum fine or term of imprisonment permitted to be imposed by the court having jurisdiction over the violation of this article of the Code of the Borough of Ridgefield; provided, however, that the fine shall not be less than $100 nor more than $2,000 per offense and the prison term shall not exceed 90 days in accordance with N.J.S.A. 40:49-5.
C. 
In the event of a continuing violation, each day shall constitute a separate offense.

A. 
There are hereby created and established rules and regulations for the use and operation of the Borough of Ridgefield swimming pool facilities located in Veterans Memorial Park.
B. 
Use of the swimming facilities shall be subject to such rules and regulations as may be promulgated by the Borough Council by ordinance or resolution, which shall be posted at all times upon the bulletin board at the swimming facilities, and a copy thereof shall be filed with the Borough Clerk for public inspection.
As used in this Article, the following terms shall have the meanings indicated:
AGE
Refers to each individual's age on June 1 of each year.

AREA
The total park area and swim pool complex, including town parking facilities.
PICNIC AREA
The area of the park designated for food consumption.
POOL APRON AREA
The ten-foot area of concrete immediately surrounding the pool.
POOL AREA
The entire fenced area surrounding the pools and the bathhouse.
POOL PATIO
Remainder of concrete area surrounding the pool.
A. 
Membership is limited to permanent residents and is not transferable.
B. 
Types of membership.
(1) 
Family membership: includes husband, wife and unmarried children under 22 residing within the same household.
(2) 
Husband and wife membership: must be “legally” married. (Couples who reside together but are not legally married cannot utilize this membership category.)

(3) 
Head of household membership: for single parents or families in which only one parent or guardian over the age of 18 wishes to join with his or her children, birth through 22 years of age.

Individual: 10 years and older. Parents must sign for minors.

(5) 
Senior citizen membership: available to permanent residents 62 years of age or older.
(6) 
Special membership may be granted under unusual circumstances upon the recommendation of the Recreation and Parks Commission.
(7) 
Nonresident Borough employees: available to nonresident employees of the Borough of Ridgefield and their families.
(8) 
A limited number of nonresidents will be allowed to join, subject to being sponsored by a resident swim pool member. Resident pool members may sponsor nonresident pool memberships. Any person caught registering as a resident who isn’t one is subject to immediate revocation of membership and loss of pool registration fee.

All memberships are granted subject to the rules and regulations as established by the Borough Council by ordinance or resolution. Failure to abide by these rules and regulations may result in revocation or suspension of membership.

(1) 
Swim pool members are entitled to purchase guest cards (limit two per season, 12 admittances per card for $90 and six admittances per card for $50). Checks should be made payable to the order of the Ridgefield Swim Pool. Unused admittances shall be valid in future seasons. Guest cards may only be purchased and used by current pool members and are nontransferable.

Swim pool members must accompany their guest or guests on the daily rate plan.
C. 
The manager will have the authority to restrict guests whenever facilities become crowded. Members are responsible for their guests at the swim pool.

Preseason pool dates will begin the Saturday of Memorial Day weekend. The pool will be open only on weekends and on Monday, Memorial Day, until the regular season begins. The regular season pool hours will begin on the fourth Monday of June. Preseason pool hours of operation shall be 11:00 a.m. to 7:00 p.m. The pool will be closed on the day of the fireworks celebration.

Swim team use of Olympic pool (the Olympic pool and training pool are one and the same).
(1) 
Members of the Ridgefield Swim Team shall have access to the Olympic pool on the following basis:
(a) 
Five to eight age group: 8:00 a.m. to 9:00 a.m.
(b) 
Nine to 12 age group: 9:00 a.m. to 10:00 a.m.
(c) 
Thirteen to 18 age group: 10:00 a.m. to 11:00 a.m.
NOTE: Such schedules shall be subject to coaches' discretion.
(2) 
Swim team members of all ages shall be allowed to enter and use the Olympic pool from 4:00 p.m. to 8:00 p.m., under pool management, parent or guardian supervision. One lane of the pool during this period shall be designated "for swim team lap swimming" with no more than six swimmers using that lane at any one time.
(3) 
Members of the swim team shall be allowed practice time from 7:00 p.m. to 8:00 p.m., Monday through Thursday, during which time a maximum of two lanes will be available for swim team practice.
A. 
All members will be issued identification badges which must be shown for admission to the area and be exhibited at all times within the area.
B. 
Identification badges will not be transferable.
C. 
Illegal transfer of badges, the giving of false information or defacing of identification badges will result in revocation or suspension of membership.
D. 
Lost identification badges must be reported to the pool manager immediately and can be replaced by the following:
(1) 
There is a fee of $10 for each replacement badge. There is a charge of $3 for each member who forgets to bring his/her badge and then must be given a daily member wristband.

A. 
All bathers, including babies, must wear bathing suits in the swimming and wading pools.
B. 
All persons using the pool must shower prior to entering the pool using warm water and soap.
C. 
Any person having a communicable disease, open blisters or cuts, sore or inflamed eyes, nose or mouth infections, excessive sunburn or any type of skin disease will be excluded from the pool area. No person having any type of bandage, cast or band-aid shall be permitted in the pool.
D. 
No inflatable water paraphernalia shall be allowed within the pool area. Snorkles, fins, masks or other swimming aids shall be permitted on a special permit.
E. 
Diving will be permitted in designated areas only.
F. 
No one will be allowed in the water unless a lifeguard is present.
G. 
No swimming will be permitted in diving areas.
H. 
Children up to and including six years of age will be permitted in the wading pool. The children must be accompanied to the wading pool by an adult, who must remain in the wading pool area.
I. 
To be allowed in the main pool, the member must be at least three years of age and toilet trained.
J. 
Children who are not toilet trained must have rubber/plastic pants on to be allowed in the wading pool.
K. 
Anything not specifically covered in the rules that affects the health, safety and comfort of the members will be left to the direction of the Pool Commission and Borough Council.
L. 
Various types of swimming instructions will be made available to residents of the Borough of Ridgefield who are six years of age or older.
M. 
No rain checks will be issued after 3:00 p.m.
A. 
All vehicles shall park in designated areas.
B. 
Street clothing shall be left in designated areas.
C. 
No person shall comb their hair within the pool apron area. Curlers shall not be worn within the pool apron area.
D. 
Dressing and undressing will be done in locker rooms only. Dressing and undressing will not be permitted in the parking area or pool area.
E. 
All food will be served and consumed within designated areas only. Under no circumstances shall food or beverages be brought into the pool area.
F. 
Children under 10 years of age will not be admitted to the pool area unless accompanied by a responsible adult member 15 years of age or older who must remain in the pool area with the children.
G. 
Destruction of property will result in suspension or revocation of membership.
H. 
The pool management will not be responsible for valuables brought into the pool area.
I. 
All litter, paper or debris must be placed in designated trash receptacles. Violators will be subject to ejection from the pool.
J. 
Card tables, umbrellas (chair size) and similar paraphernalia will be permitted in designated areas only. Chair umbrellas must possess restricted clamp for stability.
K. 
Dress in and out of the pool will be consistent with standards of good taste. Brief-type swimming attire is not considered suitable.
L. 
Street shoes will not be permitted within the pool apron area.
M. 
The hanging of towels, clothing apparel and bathing apparel on swim pool fences will not be allowed.
A. 
No glass or metal containers will be permitted within the pool area.
B. 
No alcoholic beverages or drugs will be permitted within the pool area.
C. 
No bikes, baby carriages or strollers will be permitted unless parked in designated areas.
D. 
No wrestling, running, ball playing or other similar activity will be allowed within the pool apron and parking area.
E. 
No radios, phonographs, television sets or Walkman-type radios can be operated at pool side. Walkman type permitted in the swim pool area.
F. 
No pets or animals will be allowed in the pool area.
G. 
No blowing of horns or loitering will be permitted in the parking area.
H. 
Smoking is prohibited.

I. 
No spitting, expectoration, spouting of water or other similar actions will be allowed in the pool area.
J. 
No roughness, rowdiness, profanity or other conduct affecting the safety and comfort of others will be permitted.
K. 
No soliciting will be permitted in the pool and park areas.
A. 
Regulations and rules shall be posted at the pools and pool complex building and strictly enforced.
B. 
Copies of rules and regulations will be distributed to all members.
C. 
Said Borough Council, Pool Manager or Assistant Manager may close or limit the swimming facilities whenever in his or its judgment such action is deemed necessary or desirable for the protection of health or safety of such persons entitled to use such facilities.
D. 
Members of the Police Department of the Borough of Ridgefield, designated agents of the Recreation and Park Commission, the Pool Manager and Assistant Manager and all other lifeguards, when on duty at the swimming facilities, shall have the authority to prohibit any action or conduct which they may consider to be dangerous, improper or immoral or any act or actions in violation of rules and regulations hereinbefore provided and shall have the power of expulsion or suspension or privileges otherwise granted to the holder of the membership card.

A. 
The head of the Ridgefield Public Swimming Pool shall be the Pool Director, who shall be appointed by the Mayor and Council and who shall serve at the pleasure of the Mayor and Council. The term of office of the Pool Director shall be for one year.
B. 
Pool Director.

The Pool Director shall prepare, submit and administer pool operating and capital budgets; advertise, interview, evaluate and employ necessary staff for the pool; work along with the Department of Public Works in maintaining and ordering new equipment necessary for running the pool filters; order all pool chemicals; prepare and mail the pool brochure; research and obtain price quotes for purchase of materials and supplies pertinent to pool operations as well as prepare requisitions; conduct meetings as needed with pool staff and DPW to review requirements and schedule projects and update status of assigned tasks; solicit snack bar vendor; and work alongside the Pool Manager/Assistant Manager in the following tasks:
(a) 
General water care through operation and preventative maintenance of filtration and chlorinating systems;
(b) 
Inspect the pool facilities and maintain a safe, efficient pool environment;
(c) 
Manage work schedules of hourly staff;
(d) 
Plan and promote special events.
(2) 
The Pool Director has the authority to advertise for pool membership when deemed necessary.

A. 
Any person or persons violating any of the provisions of this article may have their membership suspended by any of the stated enforcement authorities until the jurisdiction in such actions.
B. 
Any person or persons convicted of a violation of a provision of this article or any supplement thereto shall have their membership revoked or be subject to a fine, to be set by the Magistrate, the maximum amount of which shall be the maximum fine permitted by that court of jurisdiction.
The provision of this article shall not relieve any person of the duty to observe other provisions as set forth in any New Jersey statute or ordinance of the Borough of Ridgefield or as hereinafter provided.
All matters not determined by this article shall be determined by resolutions to be hereafter adopted. The rules and regulations and administrative procedures, including but not limited to such items as membership, guest policy, fees, hours of operation, identification badges, pool and general rules and general prohibitions, may be altered or amended by resolution of the Mayor and Council of the Borough of Ridgefield.
