Prior to paving or repaving of any street service,
the Division of Water and Sewer shall give notice to all owners of
adjacent property to renew their water service or to have service
installed prior to the date specified in the notice. Notice shall
be served at least 30 days prior to the specified date by mailing
a copy to the owner at his/her last known address. Failure of a properly
owner to actually receive such notice shall not relieve him/her from
complying with the provisions of this section.
Whenever an adjoining property owner fails to
make timely application for renewal, the Division of Water and Sewer
shall have discretion to decide whether such renewal should be made.
In event of an affirmative decision, cost of the renewal including
cost of a permit for a street excavation shall be charged to the property
owner, and shall be in addition to any penalty which may be imposed
for a violation of this article.
No water service shall be installed or renewed
for five years subsequent to the paving or repaving of a street except
when City Council, by resolution, shall determine it is necessary.
When a water main break occurs where a street
surface is undermined due to a water leak involving a large area so
that it becomes necessary to make extensive repairs, the cost of such
repairs, including the cost of replacing the street surface, may be
charged in whole or in part to the owner or owners of adjoining property,
as the City Council, by resolution, shall determine.
