This article shall be known as the "Schedule of Fees for Provision of Certified Assessment Data and Additional Verification of Assessment Information by Town Assessors" Local Law.
The Town Board of the Town of Gardiner hereby acknowledges that certain requirements mandated by Rules and Regulations of the New York State Board of Real Property Services will impose substantial additional costs upon the municipality; that the certifications and verifications required by the state rules are for the sole benefit of the state agency and are not otherwise required for local assessment purposes; that the state agency, pursuant to § 202 of the Real Property Tax Law, is solely responsible for establishing state equalization rates for each county, city, town and village; that § 202 of the Real Property Tax Law authorizes the state agency to obtain information from local agencies for this purpose; and that the actual costs incurred by the Town for certifications and additional verifications of local assessment information should be paid by the state agency.
This article shall apply to the actual costs incurred by the Town related to the certification of the local assessment roll and the verification by local Assessor of real property data which may have been collected by a different Assessor or by a contractor authorized by the Town.
All requests for certification of local assessment data and verification of real property data shall be made in writing and accompanied by payment of the estimated costs of such service. The local Assessor shall prepare the estimate of fee.
The fee to be charged shall include the actual costs of such service, including time expended by local Assessors and administrative staff, mileage, reproduction costs and any other expenses to the Town directly associated with the request. The actual costs of time expended shall be calculated at the current hourly wage rate together with benefits for administrative staff together with a proportional amount of the annual salary of the local Assessor.
The certified assessment information and verified real property data provided to persons or agencies under this article shall bear the raised Seal of the Town of Gardiner.
Nothing contained herein shall impose any additional fee for the reproduction of existing local assessment information, assessment rolls, or real property data ordinarily available for public inspection at the office of the local Assessor.
