This article authorizes the Town Council of the Town of Hyde Park to declare an emergency in its discretion concerning water uses in the Town of Hyde Park by persons, partnerships, corporations or districts where said Town Board makes a finding that an emergency may exist in times of drought, hot weather or other circumstances where water supply becomes low and which may result in either a limited supply of water to the users thereof, or no water at all, or other circumstances where strict conservation measures are required.
In the event that the Town Board declares such water emergency, said Board may notify the users thereof to limit such use or to cease such water usage. In the event that such user violates the direction of the Town Board, such user may be issued an appearance ticket before the Town Justice Court, Town of Hyde Park, by the Town of Hyde Park Police Department for violation of this article.
However, in the event that the Town Board declares such water emergency, the Town Board may direct, without notice, that any such water supply be cut off from any users thereof.
Where a user refuses to comply with the direction of the Town Board concerning a discontinuance of such water usage, such refusal shall be presumptive evidence of a violation of this article.
A violation of this article shall be an offense punishable by a fine of $50 for each day the violation continues.
