Regular meetings of the City Council shall be held on the Monday of each week, commencing at 8:00 p.m., and may from time to time be suspended by a majority vote of the City Council. Special meetings may be called by the President and shall be called at the written request of three members. Special meetings may also be called by the Mayor. Members shall be notified of all special meetings on or before 12:00 noon on the day of the meeting.
All fees, charges and commissions of every kind and description allowed by law to the City Clerk, City Treasurer and Collector of Taxes or any other official of the City shall be paid by such official into the treasury of the City and become the property thereof in accordance with MGL c. 41, § 108. Such compensation as the City Council may from time to time determine to pay such officials for their services shall be deemed compensation in full for all such services.
All deeds, conveyances, leases and other instruments, which shall be given by the City and which must be signed, sealed and acknowledged, shall be signed and acknowledged and delivered by the Mayor on behalf of the City, who shall affix thereto the City Seal.
Whenever the amount due and payable on any mortgage belonging to the City is paid to the Treasurer, he shall certify the same to the Mayor, who shall thereupon discharge the mortgage or, by and with the consent of the City Council, may assign the same without liability of or recourse to the City, and for that purpose the Mayor shall execute and deliver all necessary papers.

When a person entitled to redeem an estate sold for nonpayment of taxes or assessments and purchased by the City makes application for such redemption, the Mayor may, on the payment to the Treasurer of the amount due to the City on such estate, execute, in behalf of the City, any and all legal instruments that may be necessary to vest in such person the City's title to such estate. Transactions under this section shall comply with MGL Chapter 30B

No contract involving the creation of an obligation against another in favor of the City of $5,000 or more, except for grants, gifts and obligations otherwise authorized, shall be made unless it is in writing, approved by the Mayor and authorized by a vote of the City Council, provided further that any such agreement subject to Chapter 30B of the General Laws shall also be signed by the Chief Procurement Officer. In the disposal of surplus supplies pursuant to § 15 of said Chapter 30B, the Mayor may declare a municipal supply as surplus, providing the item has a resale or salvage value estimated at less than $5,000.

No proposal shall be received from any person offering to contract for such work, materials or supplies referred to in the MGL c. 43, §§ 28 and 29, unless the same is sealed.
B. 
All proposals shall be publicly opened and recorded, at the hour and place designated in the advertisement, in the presence of the Mayor or such person as he may designate. The contract shall be awarded to the lowest bidder complying with the terms; provided, however, that if any such proposal shall be offered by any person who, in the judgment of the board or department issuing the advertisement, shall be incompetent to perform this contract in a workmanlike manner, or irresponsible in respect to the means of faithfully executing the same, such proposal may be rejected, notwithstanding the same be at a lower rate than other proposals offered for the same work, materials or supplies, and the next highest bidder shall be substituted, and provided, also, that in all cases the board or department may reject all bids and issue new advertisements. All bids shall be preserved by the board or department issuing the advertisement on the record of its department and shall be opened to public inspection after the contract has been awarded and accepted by the bidder.

Position created; term. There shall be a Clerk of Committees appointed by the President of the City Council, subject to confirmation by majority vote of the members of the said Council, who shall serve in said position until such time as the individual resigns or is removed as set forth in Subsection B of this section.
B. 
Removal. No individual serving as Clerk of Committees of the City Council, once appointed pursuant to Subsection A of this section, shall be removed from said position other than by motion of a City Councilor and majority vote of the Council.
C. 
Duties. The duties of the Clerk of Committees shall include but not be limited to the following: attending committee meetings and making proper records of all proceedings and votes of said committees; assisting the members of the several committees in the conduct of business of said committees.

There shall be a Secretary/Research Assistant to the City Council appointed by the President of the City Council, subject to confirmation by majority vote of the members of said Council, who shall serve in said position until such time as the individual resigns or is removed as set forth in Subsection B of this section.

Removal. No individual serving as Secretary/Research Assistant to the City Council, once appointed pursuant to Subsection A of this section, shall be removed from said position other than by motion of a City Councilor and majority vote of the Council.
C. 
Duties. The duties of the Secretary/Research Assistant to the City Council shall include but not be limited to the following: attendance at all regular or special City Council meetings; performance of all secretarial duties and/or administrative tasks requested by a Councilor; preparation of all notices of committee meetings; transcription of all minutes taken by the Clerk of Committees; research of laws, statutes, ordinances and case law as directed or requested by any City Councilor; preliminary drafting of proposed ordinances, subject to the final review of the City Solicitor; and maintenance of current status reports on any pending state legislation at the request of any City Councilor.

All members of the Marlborough City Council shall be considered as members of each of the Council's standing committees. The President shall name those members of each committee, to include its chairman and vice chairman, who are authorized to vote on matters while pending in committee; all other members of each committee are not authorized to vote on such matters while pending in committee. A quorum of the committee shall be determined on the basis of the voting members only.
