The purpose of this chapter is to curtail the incidents of juvenile
vandalism and malicious mischief to public and private property and the incidents
or other juvenile crime by restricting and prohibiting the presence of children
under 17 years of age on the public streets and upon public and private lands
during the peak times of vandalism and juvenile offenses unless accompanied
by a responsible adult.
It shall be unlawful for any person under 17 years of age to be or remain
upon any street, other public place or upon private property without the express
invitation of the owner thereof, in the Township of Cedar Grove, between the
hours of 1:00 a.m. and 5:00 a.m. unless such child is accompanied by his parent,
legal guardian or other adult having custody of said child with the consent
and authorization of his parent or legal guardian.
A violation of the prohibition set forth in §
122-2 shall not be deemed to have occurred when either of the following circumstances are satisfied:
A. Where the parent, legal guardian or other adult having
custody of such child has prenotified the Cedar Grove Police Department in
writing that the child has his permission to be out between the hours of 1:00
a.m. and 5:00 a.m. and the reason therefor.
B. Where, as a result of an emergency situation presenting a danger to life, safety or property, the child was required to be out of his home and in the prohibited area set forth in §
122-2.
It shall be unlawful for any parent, legal guardian or other adult having custody of any child under 17 years of age to knowingly, or under circumstances where he should reasonably have known, allow or permit such child to go or be upon any public street or upon public or private lands in violation of §
122-2, except in cases of emergency or necessity in accordance with §
122-3.
