No person shall, within the limits of the Township, allow, suffer or permit the display for sale of any goods, wares or merchandise upon the streets, walkways or sidewalks of the Township, or upon private property in any residential district, as defined in the Zoning Ordinance.[1] A sale of used goods, wares and merchandise, commonly known as a "garage sale," "lawn sale," "attic sale," or "estate sale," may be permitted in any residential district as defined in the Zoning Ordinance upon a permit from Construction Official/Code Enforcement Officer, which permit shall be valid for not more than two consecutive days. Unless such sale is held within two months of the date of the permit, such permit shall expire by limitation. Each owner-applicant may apply for said permit not more than twice each calendar year. The fee for such permit shall be $5.

All garage sales shall be conducted only between the hours of 8:00 a.m. and 6:00 p.m.
No signs advertising the sale shall be posted on any place other than the premises where the sale is to be held. The sign shall not be larger than two feet by two feet in size and may not be displayed on any premises earlier than one week before the sale and shall be removed within 24 hours after the sale. Sales shall be conducted only in the residence, garage, driveway or rear yard.

Any violation of this article shall be punishable by a fine up to $2,000. Each day that the violation exists shall constitute a separate violation.

It shall be unlawful for any person to offer for sale any mattress, bedspring, cot, lounge or sofa in any garage, lawn, attic, or estate sale authorized under this article without first complying with N.J.S.A. §§ 26:10-1 through 26:10-18 with respect to the labeling, sterilizing, and disinfecting of any mattress, bedspring, cot, lounge or sofa.
