Before any street now or hereafter dedicated
to public use is accepted by the Council as a public street, the conditions
and requirements of this article, including those relating to street
improvements, must be complied with as hereinafter set forth.
The location and dimension of the street and other public improvements shall be approved by the Township Planning Board in conformity with official Township specifications, Chapter
234, Subdivision of Land, and the Master Plan adopted by the Planning Board.
The Township Engineer shall furnish the Council
with written approval or certification as to all engineering details,
including certification that the road or street and all other improvements
have been installed according to all Township specifications and ordinances
and in accordance with requirements of the Planning Board.

After any street is completed and approved and certified as set forth in §
230-10, a deed shall be properly executed by the owner or owners of all land lying within the bed of the street conveying said land lying within the bed of the street to the Township in fee simple and free of all encumbrances, including taxes and assessments. The said executed deed shall be accompanied by:
A. Three maps accurately delineating the street and showing
the location of all utilities.
B. A maintenance bond issued by a surety company licensed
to do business in New Jersey and having an office in Essex County
upon whom service of process may be made. Said bond shall be in an
amount equal to 1/4 of the cost of the public improvements installed
or made in or on said street. Said bond shall contain a condition
requiring the principal named therein to maintain said street and
other public improvements and make all necessary repairs therein resulting
from defects in workmanship and materials and the construction thereof
for a period of five years from the date of acceptance of said street.

The Council may waive requirements of this article
relating to the installation of sidewalks, curbs and the width of
streets whenever it appears that the strict application of said requirements
would result in peculiar and exceptional practical difficulties to
or exceptional and undue hardship upon the owner or owners of the
property or properties involved, and a showing, by proof, of exceptional
topographic conditions or engineering difficulties.

No provision of this article shall be deemed to affect the powers of the Township Planning Board conferred pursuant to Chapter
234, Subdivision of Land, and the amendments thereof and supplements thereto.
