No zoning permit shall be granted for the construction, alteration, use, or change in use of any building, structure, or land where the proposed construction, alteration, use or change in use would be in violation of any provision of this chapter unless a variance has been granted to authorize such deviation by the appropriate reviewing board in accordance with Chapter
38, Land Use Procedures, and the New Jersey Municipal Land Use Law (N.J.S.A. 40:55D-1 et seq.).
All variance applications shall be filed with
the applicable reviewing board, or if the Board so designates, the
Administrative Officer, for determination of completeness pursuant
to the duly adopted checklist. The Board or its Administrative Officer
shall determine within 45 days of filing of an application, whether
the application is complete and shall notify the applicant in writing
of any deficiencies within such time. The Board may waive submission
of any required exhibits in appropriate cases and for specific variance
applications.
All variance applications shall contain the information and data described in the following checklist. Variance applications which accompany a subdivision or site plan application shall also include all the information and data required for submission of the subdivision or site plan application, pursuant to Chapter
234 or Article
X of this chapter, respectively.
A. Eighteen copies of the application form inclusive
of a brief description of the project and the proposed use or uses
of the land and buildings, the landscape plan checklist, the environmental
questionnaire, and the required fees.
B. Eighteen copies of a plot plan providing lot dimensions,
property metes and boundary lines, location of existing and proposed
structures, required yard setback lines, existing and proposed setback
distances for buildings and structures, location of driveway(s), sidewalks,
and parking areas.
C. A zoning comparison chart listing the standards of
the Schedule of Requirements table for the district in which the property
is located and providing the figures for each standard, as they are
proposed within the application.
D. Copies of the application, when same is required,
to the Essex County Planning Board for approval of a subdivision or
site plan.
E. Written certification from the Township Tax Collector
that all property taxes and assessments are paid and current.
F. The names of all owners of record of all properties
within 200 feet of the subject parcel(s) as they appear on the Certified
Tax List prepared by the Township Tax Assessor and the block and lot
numbers of the properties.
G. Preliminary architectural plans for any proposed building,
building addition, or structure, indicating typical floor plans, elevations,
height and general design and architectural styling.
H. A copy of any covenants or deed restrictions that
are intended to cover all or any part of the tract.
I. Such other information or data as may be required
by the Board in order to render a decision in the matter.
J. A list of any checklist items for which waivers are
specifically requested and a narrative paragraph explaining why the
applicant is entitled to such waivers.
