The purpose of this article is to provide for the duties and responsibilities
of the Township Manager functioning under the provisions of the First Class
Township Code. It is intended that the Township Manager shall be responsible
for supervising and conducting the administrative affairs of the Township
in a nonpartisan manner. Nothing herein shall be construed to diminish or
impair any of the statutorily imposed or discretionary powers or responsibilities
of the Commissioners reserved to them by law.
The office of Township Manager (the "Manager") is hereby created by
the Township of Caln pursuant to § 1502 of the First Class Township
Code.[1]

The Manager shall be appointed for an indefinite term by a majority
of all of the members of the Board of Commissioners (the Board). The Manager
shall serve at the pleasure of the Board, and he may be removed at any time
by a majority vote of all its members. The Board shall enter into a memorandum
of understanding with the Manager setting forth the terms and conditions of
employment. (Throughout this article, reference to the Manager in the masculine
shall be construed to include the feminine.)
The Board shall retain primary power and responsibility for the governance
of the Township. The Board shall act as a body in its dealings with the Manager,
provided that a quorum of the Board shall be authorized to so act. Individual
Board members shall have the right at anytime to contact the Manager or any
subordinate of the Manager for information or to discuss any item of Township
business; however, individual Board members shall not interfere with the Manager
or any of his subordinates in the performance of their duties. The Board may,
however, establish a temporary committee or liaison of its members to review
the operations of the Township and its departments.
The Manager shall be chosen solely on the basis of executive and administrative
qualifications, with special reference to training and experience in municipal
government and the ability to deal in an amicable and professional manner
with the general public and Township officials and employees. The Manager
need not be a resident of the Township at the time of his appointment, but
shall become a permanent Township resident within one year of the date of
his employment as Manager, unless an exception is granted by the Board.
Before entering upon his duties, the Manager shall give a bond to the
Township with a bonding company authorized to conduct such business in the
Commonwealth of Pennsylvania, as surety, in a sum to be determined annually
by the Board, conditioned upon the faithful performance of his duties. The
bond shall be subject to the approval of the Board, and the premium for the
bond shall be paid by the Township.
A.
The Manager shall be the chief administrative officer
of the Township, and he shall be responsible to the Board as a whole for the
proper, efficient and economical administration of the Township's affairs.
The Manager shall conduct himself at all times with complete fidelity and
in a manner that will reflect credit upon, and benefit to, the Township and
its government as a whole. The power and duties of administration of Township
business, as provided for in this article or in directives of the Board as
related thereto, shall be vested in the Manager, unless expressly imposed
or conferred by statute upon the Commissioners or other Township officers
or officials.
B.
Subject to recall by ordinance of the Board, the powers
and duties of the Township Manager shall be the following:
(1)
He shall supervise and be responsible for the activities
of all municipal departments and their employees, provided, the Chief of Police
shall have and retain direct supervisory control over the operations of the
Police Department and all police officers serving under the Chief, but the
Chief of Police shall report directly to the Township Manager as the chief
administrative and executive officer of the Township. As to all municipal
departments, the Township Manager shall also have and retain supervisory responsibility
for the administration of all fiscal matters pertaining to all municipal departments
without exception.

He shall, subject to the knowledge of the Board, hire
and, when deemed necessary, suspend or discharge any employee under his supervision.
The hiring or discharge of a seasonal employee shall not be subject to the
review of the Board.
(3)
With the concurrence of the Board, he shall have the
authority to fix wages and salaries of all personnel under his supervision.
(4)
He shall prepare and submit to the Board, not less than
45 days before the close of each fiscal year, a budget for the next fiscal
year, and an explanatory budget message. In preparing the budget, the Manager,
or an officer designated by him, shall obtain from the head of each Township
department, agency or board, or any qualified officer thereof, estimates of
revenues and expenditures and such other supporting data as he requires. The
Manager shall review such estimates and, without revisions, shall present
them to the Board, along with his own recommendations.
(5)
He shall be responsible for the administration of the
budget after its adoption by the Board.
(6)
He shall, in conjunction with the preparation of the
yearly budget, develop long-range fiscal plans for the Township, such plans
to be presented annually to the Board for its review and adoption at such
time as the Board shall direct.
(7)
He shall hold such other Township offices, if permitted
by law, and head such Township departments as the Board may, from time to
time, direct.
(8)
He shall attend all meetings of the Board and its commissions
and committees, unless specific permission of the Board is given to do otherwise.
He shall have the right to take part in the discussions, subject to the control
of the President or Chairperson thereof, and he shall be given notice of all
special meetings of the Board and its commissions and committees.
(9)
He shall prepare the agenda for each regularly scheduled
meeting of the Board and distribute it to the Board at least four days prior
to each meeting and supply all facts within his knowledge pertinent thereto.
(10)
He shall keep the Board informed on a regular and continuing
basis as to the conduct of Township affairs, submit periodic reports on the
condition of the Township finances and such other reports as the Board requests
and make such recommendations to the Board as he deems advisable.
(11)
He shall submit to the Board, as soon as possible after
the close of the fiscal year, a complete report on the finances and the administrative
activities of the Township for the preceding year.
(12)
He shall see that the provisions of all franchises, leases,
permits and privileges granted by the Township are observed, and shall be
responsible to oversee the enforcement and administration of all Township
ordinances, resolutions and regulations.
(13)
He may employ, subject to the prior approval of the Board,
experts and consultants to perform work and to advise in connection with any
of the functions of the Township.
(14)
He shall attend to the letting of contracts in due form
of law, and he shall supervise the performance and faithful execution of the
same, except insofar as such duties are expressly imposed by statute upon
the Board or other Township officer or official.
(15)
He shall see that all money owed to the Township is promptly
paid, and that proper and adequate action or proceedings are taken for the
security and collection of all Township claims and entitlements.
(16)
He shall be the purchasing officer of the Township, and
he shall purchase, in accordance with the provisions of the First Class Township
Code, all supplies and equipment for the departments under his supervision
and for such other departments, offices, agencies and boards of the Township
as the Board may, from time to time, direct.
(17)
All complaints regarding Township services shall be referred
to the office of the Manager. The Manager, or an officer designated by him,
shall investigate and properly resolve or otherwise dispose of all such complaints,
and he shall routinely report thereon to the Board, or as the Board may otherwise
direct.
(18)
He shall thoroughly analyze all mailers requiring Board
decision and/or action, and he shall represent fairly and objectively to the
Board all facts pertinent to these decisions and/or actions.
(19)
He shall maintain a high level of public relations for
all elements of the Township government, including periodic reports and such
other information as he may be directed to prepare, from time to time, by
the Board.
(20)
He shall adhere to the International City/County Management
Association "ICMA" Code of Ethics.
(21)
He shall perform all other duties as requested by the
Board.
If the Manager becomes ill or needs to be absent from the Township,
he shall, with the concurrence of the Board, designate one qualified member
of his staff to perform the duties of the Manager during his absence or disability.

There is hereby created the office or position of Director-Finance Utility
Sewer Fund.
The Director-Finance Utility Sewer Fund, hereinafter called the "Director,"
shall be charged with the following duties and responsibilities:
A.
General duties. Administer, levy, collect, record, report
and certify the Utility Fund duplicate.
B.
Specific duties.
(1)
Prepare each year two complete lists of all ratables,
one list to be filed with the Township Secretary for audit and the second
list to be used for posting all payments of ratables by the Director of the
Utility Fund.
(2)
Be responsible for the preparation and mailing of quarterly
utility bills.
(3)
Be responsible for the collection, posting and reporting
of all collection of utility funds monthly and yearly.
(4)
Be responsible for depositing, balancing and reconciling
the utility account.
(5)
Prepare and mail out delinquent rental reminders.
(6)
Prepare liens for delinquent rental.
(7)
Testify at all levels of court.
(8)
Be responsible for the proper equipment used to print,
post and calculate Utility Fund bills and reports.
(9)
Be responsible for the operation and instruction in the
use of all office equipment.
(10)
Be responsible for securing the necessary supplies, ledgers
and other office forms and supplies.
(11)
Be responsible for the instruction and performance of
and moneys handled by all deputies and clerks.
(12)
Prepare for the Commissioners each year a proper cost
for the budget to operate the Utility Fund.
(13)
Be responsible for investments, transfers and budget
control of the Utility Fund.
(14)
Be responsible for assistance to the Commissioners and
Manager in preparing the utility budget.
(15)
Be directed by the Commissioner of Finance and be responsible
to all the Commissioners as a Board.
The Director shall serve for a term of two years and until his successor
is duly appointed and qualified, unless sooner removed by the Board of Commissioners.
The compensation of the Director shall be set annually at the meeting
wherein the budget of the Township is adopted or at such later date as the
Commissioners may determine. The salary shall be set by resolution by the
Board of Commissioners.
