A. 
Township parks are acquired and maintained for the benefit of Township residents. The rules and regulations contained in this chapter are hereby established for the management and protection of all parks and playgrounds located in the Township (hereinafter designated as "parks").
B. 
All real estate owned by the Township now established or hereafter designated as parks and recreation areas shall be controlled by the rules and regulations herein established. All real estate hereafter acquired by the Township and designated as parks and recreation areas by the Board of Commissioners (the "Commissioners") shall, upon dedication and/or conveyance of title to the Township, be governed by the provisions of this chapter without the necessity of further action by the Commissioners.
C. 
The various programs and facilities sponsored by the Township's Park and Recreation Board (the "Park Board") on a regular and/or periodic basis are intended for the enjoyment of the residents of Caln Township.
D. 
It is the intention of the Park Board to sponsor, or cause to be organized, activities of interest to residents of all ages and interests and to fill the recreational needs of the community.
E. 
Since the Park Board is not the sole provider of recreational programs within the Township, the Park Board will attempt, whenever possible, to cooperate with other recreational providers such as the local school districts, youth leagues, little leagues, scouts and churches as long as there is a benefit to the Township residents.

A. 
All parks shall be open daily between dawn and dusk. No persons other than authorized employees of the Township shall be in any park at any time between dusk and dawn. At dusk, all activities in the parks, with the exception of those activities sponsored by the Park Board or the Township, or activities by persons with a permit or other written authorization by the Township as hereinafter provided, shall cease, and all unauthorized persons shall promptly leave.
B. 
The Township may close the parks or any portion of the parks for special events and activities sponsored by the Township or Park Board. The Township or Park Board shall provide notice of the park closure by posting in the park in advance of the closing.

No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures therein or any other property of the Township located within the parks. No person shall interfere with and/or disturb wildlife within the park.

No person shall climb, stand upon or remove any bench, seat, table, fence, grill or recreational equipment or facility from any park or change the location thereof without permission from the Park Board.

No person shall conduct himself within the parks so as to annoy any other person using the parks for recreational purposes. No person shall use or allow to be used within the park any drugs, tobacco products, electronic nicotine delivery devices or alcohol. No person shall utter profanity or engage in any indecent activities or gambling. Further, no person shall engage in any solicitation or sale of any product or services within the park. Any Township police officer or other law enforcement official may forthwith remove any person from any Township park for such conduct.

A. 
No person or organization shall hold any meeting or gathering, assembled through advertisement or public notice, or any gathering otherwise assembled and composed of 25 or more persons, within the limits of the parks, without first having made application to the Township Secretary for a permit. Such permit shall indicate the spot in the park where such gathering or meeting shall be held, and such gathering shall not be held at any other spot within the park.

B. 
Permits, as set forth in § 107-7, shall be required for any organized use of any fields or courts within the park.

C. 
Nonresidents shall be required to obtain sponsorship from a Township resident prior to being granted a permit for use of the parks.

An application for a park permit shall be obtained at the Township Municipal Building and shall be in the name of the person who shall be responsible for seeing that all refuse left by the group shall be placed in proper containers or removed from the grounds before leaving the park. The application for the permit shall also indicate the sponsoring person(s) or organization(s), the approximate number of persons attending the planned event, the hours for which the planned event is scheduled, equipment to be used and such other pertinent information as required. The application for such permit shall be made at least 72 hours prior to the time of the planned use for which permission is being requested.

For all gatherings for which police security is deemed necessary by the Township, such security must be paid for by the sponsor(s) of the gathering. The number of security personnel or police security shall be determined by the Chief of Police. The Township Manager must receive confirmation of the security arrangements before final approval of the permit.

Motor vehicles of any kind are not allowed on park grounds without special permission from the Township, except those vehicles used in the course of park maintenance or other necessary activity. Parking of motor vehicles within the park shall only be within designated parking lots to the extent parking lots exist within any park.

No person shall set up any booth, table, stand or structure whatsoever within the limits of the parks without the consent of the Board of Commissioners, which shall have authority to refuse such consent in any instance. There shall be no solicitation of any kind for personal profit within any park, and no person shall sell or offer for sale any object or merchandise or other object of value in any park without the consent of the Park Board.
No person shall dispose of any waste or garbage in the parks except in the receptacles designated for the respective purposes. All persons using the parks shall dispose of all waste and garbage left by them in such proper receptacles.
No person shall injure, deface or destroy any notice, rule or regulation posted at any place within the parks by authority of the Recreation Board, nor shall any person post any notice or placard at any place within the parks other than by authority of the Recreation Board.
No person shall set or maintain any fire in the parks except in stoves and fireplaces maintained for the purpose and located by authority of the Recreation Board.

No person shall bring any intoxicating beverages into the parks either for his own use or the use of any other person, except for events and activities where the use of alcohol has been approved by the Commissioners. No person shall use any tobacco products or electronic nicotine delivery devices in Township parks, athletic fields or playgrounds. This prohibition includes cigarettes, cigars, chew, e-cigarettes, e-cigars, e-pipes, hookah, juul, pipes, snuff, snus and vape devices.

No person, other than a sworn police officer or other law enforcement officer then on duty and engaged in the performance of his official duties, shall carry or discharge any firearm or other harmful weapon within the limits of any park. No fireworks are permitted in any park without the prior written consent of the Park Board and the Fire Marshal.

No basin, pool, lake or fountain in any park shall be fouled by stone, wood or any other substance or waste materials, nor shall any such waters or facilities be used for swimming, bathing, wading, boating or other similar activity, provided that nothing herein shall preclude the Township from designating any body of water as suitable for swimming or unmotorized boating, subject to it being posted by the Township as approved for such use.

The Park Board shall have the right to refuse, restrict or cancel the use of any facility within the parks for reasons of repair, maintenance or construction or if the use may be detrimental to the care and upkeep of the park or any area within the park.

All persons shall adhere to the rules and regulations recommended by the Park Board and approved by the Commissioners. The rules and regulations shall be posted by the Township in the parks and shall govern and restrict conduct therein. No person shall injure, deface or destroy any notice, rule or regulation posted at any place within the parks. Any person violating this subsection shall be subject to expulsion from the parks and to prosecution in accordance with § 107-24.

The Park Board may require the payment of a deposit to reserve or use specified park facilities. Such deposit shall be established in a resolution duly adopted by the Commissioners from time to time and shall be based on the type of facility being used, the number of participants, anticipated length of the sponsored event and security considerations. The Township is authorized to collect a higher fee from nonresidents of the Township. The deposit shall consist of either or both a security deposit, which is refundable, to cover the costs of potential damages to Township property arising from the use of the designated facilities; and a nonrefundable facilities component to reimburse the Township for the additional maintenance costs associated with the use of the facilities. If waste or garbage is not disposed of in the proper manner, and the Township incurs expenses in cleaning up the park after the specified event, the organization or sponsoring party shall forfeit an appropriate amount of the deposit to the Township to reimburse it for such expense.

The Park Board shall have the authority to recommend that the Commissioners adopt such additional rules and regulations, from time to time, which it believes are necessary for the proper governance of the parks. Such additional rules and regulations may be approved by the Commissioners by resolution without the necessity of inclusion in this chapter and once approved shall become effective as of the date set forth in the resolution.

Any person or organization who or which is required by § 107-6 herein to obtain a permit for the use of the parks shall be entitled to receive a key for the use of the rest room facilities at the park by paying a deposit of $10 to the Township. The deposit shall be returned within 24 hours after the key is returned, provided that the rest room facilities have been inspected and found to be in a clean and sanitary condition.

Any person who shall violate any provisions of this chapter shall be subject to a citation issued by the Caln Township Police Department in an amount not less than $25 and not more than $300; provided, however, that the fine for the first violation of § 107-18 shall be $25, the second violation $50 and each subsequent violation of that section a fine of no less than $100 and not more than the maximum amount as determined by the District Justice. Such fine, plus all costs of prosecution and attorneys fees, may be enforced by the District Justice having jurisdiction thereof in the same manner as a summary offense. Each day that a violation continues shall constitute a separate offense for which the Township may impose the above-referenced fine and penalties.
