It shall be unlawful for any person to accumulate or permit to be accumulated garbage or rubbish upon private property within the Township of Hamilton aforesaid.
It shall be unlawful for any person to dump or otherwise deposit or permit to be dumped or otherwise deposited any garbage or rubbish upon private property within the Township of Hamilton aforesaid.
It shall be unlawful for any person to haul or transport by any means whatsoever any garbage or rubbish over the roads, highways or alleys within the Township of Hamilton aforesaid from a point without the limits of the Township of Hamilton for the purpose of accumulating said garbage or rubbish and/or dumping same and/or otherwise depositing same on private property within the Township of Hamilton aforesaid.
As used in this chapter, the following terms shall have the meanings indicated:
PERSON
Includes any natural person or persons, partnership, unincorporated association, corporation, municipality or any other entity whatsoever.
All accumulation, dumping and otherwise depositing of garbage or rubbish on private property within Hamilton Township aforesaid is hereby declared to be a public nuisance endangering the health, safety and welfare of the public and, in addition to the penalties under § 112-6 hereof, any person or persons found guilty of violating this chapter shall be liable by suit brought in the name of the Township for the cost of abatement of said nuisance and the removal of said garbage or rubbish from the place that it was unlawfully deposited.

Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a District Justice under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. Hamilton Township police officers, or other appropriate officer(s) of Hamilton Township, shall have the power to enforce the provisions of this chapter.
