[Adopted as Ch. 21, Part 1, of the 1983 Code]
A.
Private driveways shall enter a street no closer than 40 feet from any street to which they are, at least, roughly parallel.
B.
Unless required by other ordinances of the township, the width, radius, grade and construction of driveways shall be in accordance with minimum requirements as shown in Exhibit A attached hereto.[1]

Editor's Note: Exhibit A, Driveway Requirements, is included at the end of Ch. 115, Subdivision and Land Development.
C.
The line of the street gutter shall follow an even grade past any private driveway. Drain pipes shall be provided only with express permission of the township.
D.
No driveway shall be surfaced, widened or extended and no new driveway shall be constructed in such a manner that it obstructs the flow of surface water along the curb, gutter or street, or obstructs the normal maintenance or plowing of the street by the township. The driveway shall be so constructed that the surface water which may run on it will not be carried onto the intersecting street; instead, such water shall be diverted therefrom or confined to the adjacent gutter.
E.
If a driveway is to be extended or constructed over a drainage ditch, the property owner, at his expense, shall install a pipe in the ditch in order to permit the surface water to flow unimpeded. The size and type of pipe shall be approved by the township.
Before constructing, widening or extending any private driveway, the property owner must submit an application with a sketch of the proposed work and obtain a permit from the Code Enforcement Officer or his designee. The sketch must be approved and signed by Township Engineer. No permit shall be required for the resurfacing of an existing driveway.

Editor's Note: Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
The Township Engineer shall be notified of any construction in ample time to allow for the inspection of said work.
The fee for the permit required hereunder shall be in such amount as the Board of Supervisors shall set from time to time by resolution.
Any person who violates or permits a violation of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the township before a District Justice, pay a fine of not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the township in the enforcement of this chapter. No judgment shall be imposed until the date of the determination of the violation by the District Justice. If the defendant neither pays nor timely appeals the judgment, the township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
