A.
Municipal elections for members of City Council shall be changed from May of even-numbered years to the November general elections commencing November 2, 2004, and in even-numbered years thereafter.
B.
The terms of the four Council positions subject to expire June 30, 2004, shall be extended to December 31, 2004, and the date for the next election of those Council positions subject to election shall be extended to November 2, 2004, and then every regular November election every four years thereafter.
C.
The terms of the three remaining Council members subject to expire June 30, 2006, shall be extended to December 31, 2006, and the date for the next election for those offices shall be the regular November election date in 2006, and then every regular November election every four years thereafter, so as to retain the staggered terms of office.
D.
The members of Council shall continue to serve beyond the current expiration date of their respective terms of June 30 until their successors have been elected and qualified to serve.
E.
The terms of the newly elected Council members shall commence on the first day of January following the election and shall be for four years.
F.
The City Council shall have such powers and perform such duties with reference to the election, qualification and returns of its members as provided by Section 4.5 of the Charter and by the laws of the state. When any vacancy shall occur in the Council for any cause, the Council shall elect a qualified person to fill the vacancy for the unexpired term, except that when there shall be vacancies in the majority of the Council, the Circuit Court of the city, or the Judge thereof in vacation, shall fill such vacancies as provided in §§ 15.2-1424 and 24.2-228 of the Code of Virginia.
