The streets in the possession of the Village
are primarily for the use of the public in the ordinary way. However,
under proper circumstances, the Village Clerk may grant a permit for
street use, subject to reasonable municipal regulation and control.
Therefore, this chapter is enacted to regulate and control the use
of streets pursuant to a block party permit, to the end that the health,
safety and general welfare of the public and the good order of the
Village can be protected and maintained.
As used in this chapter, the following terms
shall have the meanings indicated:
BLOCK PARTY
A gathering, in a residential district only, of abutting
neighbors and their relatives and friends within the Village street
right-of-way or other public thoroughfare which has been temporarily
closed for the occasion. Block party permits will only be issued during
the period of May 1 through September 30.
No person shall encroach upon, occupy, obstruct
or encumber any public street or highway, or part thereof, for the
purpose of participating in a block party unless authorized to do
so in accordance with this chapter.

Before any application for a block party permit
is considered by the Village Clerk, the application shall be reviewed
by the Chief of Police and the Director of Public Works for their
recommendation as to the effect that the temporary closing of the
street will have on the public safety and traffic movement in the
area during the time the street may be closed.

Each application for a block party permit shall
be accompanied by a fee as established in the Village Fee Schedule.
Alcohol cannot be served, consumed or transported
in open containers on any public property, i.e., streets, sidewalks
and alleys.

A block party permit for an event in progress may be terminated by the Police Department if the health, safety and welfare of the public appears to be endangered by activities generated as a result of the event or the event is in violation of any of the conditions of the permits or ordinances of the Village of Pleasant Prairie. If police officers are dispatched or needed at the location of this event because of problems being created, the officers have the authority to order the street opened and, if appropriate, shall enforce §
250-8 of the Code, Loud and unnecessary noise, if the noise being produced is determined to be unreasonable.
Any person who shall violate any provision of this chapter shall be subject to a penalty as provided in Chapter
1, Article
I, of this Code.
