Districts established. For the purpose of this chapter,
the following primary use districts as found in this article are hereby
established within the Village of Theresa.
Zoning Map. A certified copy of the Official Zoning
Map shall be adopted and approved with this text as a part of this
chapter and shall bear upon its face the attestation of the Village
President and the Clerk-Treasurer of the Village of Theresa and shall
be available to the public in the office of the Clerk-Treasurer.
Accessory buildings, including private garages and
buildings clearly incidental to the residential use of the property,
provided that no such accessory buildings may be used as dwelling
units.

Day-care centers, when required to be licensed by
an agency of the state, where a person provides, for compensation,
care and maintenance of four or more children at a location other
than the child's own home or the home of relatives or guardians.
Governmental and cultural uses, such as fire and police
stations, community centers, libraries, post office, village hall,
museums, sewage disposal plants, historical sites and buildings for
the storage of road maintenance equipment.
Lot. Width and area of all lots shall be determine in accordance with § 350-12, except that lots for two-family dwellings shall be a minimum of 12,500 square feet in area and lots for multiple-family dwellings shall contain not less than 5,000 square feet per dwelling unit.

Purpose. The primary purpose of this district shall
be to provide a suitable environment for the preservation and development
of commercial establishments within the Central Business District.
Governmental and cultural uses, such as fire and police
stations, community centers, libraries, post office, village hall,
museums and historical sites or structures.
Side: there shall be no minimum side yard, except
where a lot abuts a residential zoning district; in such case the
minimum side yard shall be the same as the adjoining district.
Governmental uses, such as police or fire stations,
sewage treatment plants, garbage incinerators, or buildings used for
the storage or repair of road maintenance equipment.
Manufacturing establishments engaged in the
fabrication, processing, assembly or packaging of a product which
is not specified as a conditional use in the I-1 Industrial District.
Wholesale establishments. Retail sales of the
products produced on the premises are permitted if accessory to and
in the same structure as the principal use.
Any other trade, industry or use, without limitation
because of prior enumeration, that is noxious, offensive or in conflict
with neighboring uses for reasons of smoke, odors, noise, vibration,
dust, health hazards or possibility of accident.
Purpose. The primary purpose of this district is for
uses compatible with protecting, preserving and enhancing the river,
wetlands and areas subject to flooding within the Village.
Conditional uses and structures. The following uses, structures and activities are permitted upon issuance of a conditional use permit as provided in Article V of this chapter and issuance of a Department of Natural Resources permit, where required, provided that such uses will not increase the flood hazard to life or property and will not be adverse to the environment or value of the area. All conditional use permits shall be granted only upon a finding by the Village Board that such use or structure will not restrict a floodway or destroy the storage capacity of a floodplain.
