The provisions of this chapter shall apply to
all circuses, carnivals and mobile ride devices.
No license shall be granted or given for any
carnivals, circuses or mobile rides unless:
A. Public liability policies are posted with the Township
prior to the operation of any circus, carnival or mobile ride device,
for the satisfaction of all claims for damages by reason of bodily
injury to or the death of any one person and of all claims for damages
by reason of bodily injury to or the death of all persons resulting
from an accident. Such liability policies shall be in an amount of
not less than the following:
(1) For mobile ride devices: $1,000,000/1,000,000.
(2) For circuses and carnivals: $1,000,000/1,000,000.
B. The Fire Inspector of the Township is satisfied as
to the firesafety of the type of tent or other structure to be erected
for the purpose of any show, carnival or circus.
C. The Police Department of the Township is satisfied
that any mobile ride will not interfere with traffic or make traffic
more hazardous in a particular location where the ride is located.
It shall be unlawful to operate or permit the
operation of a circus, carnival or mobile ride between the hours of
11:00 p.m. and 6:00 a.m. of any day of any week.
It shall be the duty of the owners, operators
or occupant in charge of a carnival or circus to provide signs over
every door and exit, upon which signs the word "exit" shall appear
in letters at least six inches high and shall be illuminated during
the entire period the circus or carnival shall maintain an audience,
in accordance with state statutes and regulations.
It shall be the duty of the owners, operators
or occupant in charge of the carnival or circus to provide at their
expense adequate policing supervision and adequate supervision of
traffic control to meet the requirements of the Township Police Department.
Upon application, the Township Council may waive the license fee where carnivals, circuses or mobile ride devices are being utilized for a nonprofit organization (as that term is defined in Chapter
267, Peddling and Soliciting, §
267-2, for a charitable purpose). However, all other requirements of this chapter must be observed.
Except as provided herein, violations of this chapter shall be punishable as provided in Chapter
1, Article
III, General Penalty.
