The title of this chapter is the "Town of St. Joseph Membrane Structures and Temporary Structures Ordinance" ("chapter"). The purpose of this chapter is to regulate the construction, location, inspection and permitting of membrane structures and temporary structures. By the adoption of this chapter, International Building Code Sections 3101, 3102 and 3103 are incorporated herein.
For the purposes of this chapter, the following terms shall have the meaning set forth below:
BUILDING INSPECTOR
Any person designated by the Town of St. Joseph to perform inspections on its behalf.
COUNTY
St. Croix County, Wisconsin.
MEMBRANE STRUCTURE
Shall have the meaning as provided for in Section 3102 of the International Building Code.
OWNER
Any person having a legal interest in a temporary structure or commercial tent.
TEMPORARY STRUCTURE
Shall have the meaning as provided for in Section 3103 of the International Building Code.
TOWN
The Town of St. Joseph, St. Croix County, Wisconsin, and includes the Town's officers, employees, and agents as appropriate.
TOWN BOARD
The Board of Supervisors for the Town of St. Joseph.
TOWN CLERK
The Clerk of the Town of St. Joseph or his or her deputy.
TOWN PLANNER
The Town Planner for the Town of St. Joseph.
This chapter is divided into sections designated by numbers. Sections may be divided into subsections designated by uppercase letters. Subsections may be divided into paragraphs designated by numbers. Paragraphs may be divided into subdivisions designated by lowercase letters. Subdivisions may be divided into subdivision paragraphs designated by lowercase Roman numerals. Reference to a "section," "subsection," "paragraph," or "subdivision" includes all divisions of the referenced section, subsection, paragraph, or subdivision.
Membrane structures located within the Town shall be inspected by the Building Official in strict conformance with the requirements of Section 3102 of the International Building Code. All requirements included within Section 3102 of the International Building Code shall be applicable to membrane structures constructed and located in the Town. Prior to erecting a membrane structure, the owner desiring to erect such membrane structure shall contact the Building Official and submit a scaled site plan depicting the proposed location of the membrane structure, the location of existing structures, property lines, dedicated right-of-way, public easements, parking areas, and driveways. Additionally, membrane structures shall comply with the following local requirements:
A. 
The membrane structure shall be wholly located on the owner's property with a minimum separation of 10 feet from the principal structure that faces the property's front yard.
B. 
The Building Inspector shall identify the required number of portable restrooms required to support the membrane structure based on the occupancy load of membrane structure.
C. 
Ingress and egress to the membrane structure shall comply with be in accordance with the Americans with Disabilities Act of 1990[1] and any comparable state or local law.

D. 
Entrances and exits to the membrane structure shall be clearly marked in such quantity and in locations as directed by the Town Fire Department. Exit signs shall be secured down and required to have emergency illumination for the path of egress.
E. 
The membrane structure shall not restrict access to rights-of-way, public easements, fire lanes, fire department connections, or any other life safety elements requiring accessibility.
Temporary structures located within the Town shall be inspected by the Building Official in strict conformance with the requirements of Section 3103 of the International Building Code. All requirements included within Section 3103 of the International Building Code shall be applicable to temporary structures constructed and located in the Town, including the permitting requirements contained within Section 3103.1.2. Prior to erecting a temporary structure, the owner desiring to erect such structure shall contact the Building Official and submit a scaled site plan depicting the proposed location of the temporary structure, the location of existing structures, property lines, dedicated right-of-way, public easements, parking areas, and driveways. If required by Section 3103 of the International Building Code, a permit shall be issued prior to the erection of the temporary structure. Additionally, temporary structures shall comply with the following local requirements:
A. 
The temporary structure shall be wholly located on the owner's property with a minimum separation of 10 feet from the principal structure that faces the property's front yard.
B.

The issuance of a building permit by the Building Inspector does not relieve the owner from any of the following:
A. 
Obtaining all permits required by state law or local ordinance, including but not limited to the following:
(1) 
County sanitary permits.
(2) 
Town, county, or state driveway permits.
(3) 
Other applicable permits under state law, county regulation or Town ordinance.
B. 
Complying with all state, county and local requirements, including, but not limited to, zoning, subdivision, land division, and setback requirements.
The Town Board shall approve by resolution the form of the building permit and designate the person or persons authorized to issue the permits within the Town. The fee for a building permit shall be established by the Town Board in the Town's annual fee schedule and shall be payable at the time of application for the permit.
Any person who fails to comply with the provisions of this chapter shall, upon conviction, pay a forfeiture of not less than $200 nor more than $1,000, plus applicable surcharges, assessments, and costs for each violation. Each day a violation exists or continues constitutes a separate offense under this chapter. Additionally, the Town Board may seek injunctive relief from a court of record to enjoin further violations.
If any provision of this chapter or its application to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of this chapter that can be given effect without the invalid provision or application, and to this end the provisions of this chapter are severable.
