It shall be unlawful for any person, other than the Town, to establish, maintain, conduct or operate a solid waste disposal operation in the Town of St. Joseph.[1]

Any person, firm or corporation in violation of this article shall pay a forfeiture of $250, doubling with each violation thereafter, to a limit of $5,000.

The purpose of this article is to promote, regulate and require the separation, collection and processing of recyclable materials to the greatest extent feasible.

Owners and occupants of single-family and multifamily residences and nonresidential facilities located within or conducting business in the Town of St. Joseph are required to separate and/or recycle from their solid waste those items identified in Sections 10, 11 and 12 of the St. Croix County Recycling Municipal Solid Waste Ordinance Chapter 21.

Definitions shall include, but not be limited to, those definitions included in the St. Croix County Recycling Municipal Solid Waste Ordinance.

All solid waste haulers or recyclers conducting business within the Town of St. Joseph must provide for collection of recyclable materials at least one time per month (listed in county code). All haulers or recyclers must register with the Town Clerk and file appropriate reports as listed in § 163-9. All haulers or recyclers must offer at least one volume-based pricing option. All haulers or recyclers must provide their customers with instructions on how to sort and package their recyclable materials. A copy of this information should be provided to the Town Clerk.
A. 
Any solid waste hauler or recycler registered by the Town of St. Joseph to collect any recyclable material in the town shall be required to maintain appropriate records for the town and to report, in writing, to the Town Clerk at least annually, by February 1 of each year, sufficient and accurate information and data related to the amount, weight and type of recyclable material, waste and other material collected in the town in the previous year. The information and data to be provided shall be sufficient in detail to allow the town to meet the recyclable material collection, compliance and data requirements established for the town in Chapter NR 544 of the Wisconsin Administrative Code or its successor chapter. The annual reports must be submitted on a form available from the Town Clerk.
B. 
This report shall specifically include amounts, types and weights for newspapers, corrugated paper, magazines, aluminum containers, steel and bimetal containers, plastic containers, glass containers and foam polystyrene packages. This report may include weight slips and a statement identifying how recyclable materials are processed and marketable and what, if any, material was rejected for processing.
C. 
All documents relating to recycling in the Town of St. Joseph shall be retained for a period of three years by the solid waste hauler or recycler and shall be available for review by town officials.

If any specific portion of this article is held to be unconstitutional, unlawful or invalid by a court of competent jurisdiction, the remainder of this article shall be unaffected and remain in full force and effect.
