As used in this Article, the following terms shall have the meanings indicated:
SATELLITE DISH ANTENNA
A saucer, circular or similar shaped structure, functioning as an antenna for the purpose of receiving television, radio, microwave, satellite or similar signals, with the exception of traditional and conventional television antennas, including but not limited to such structures commonly known as โ€œhome video earth stationsโ€, โ€œsatellite dishesโ€ or โ€œsatellite earth stationsโ€
Satellite dish antennas shall be permitted in all zones within the Borough of Brooklawn but only upon full compliance with the following requirements.
No satellite dish antenna shall be located in any front yard or side yard of any property.
All satellite dish antennas must be ground-mounted at a distance from all side yard and rear yard property lines of not less than the distance equal to the height of the satellite dish from the ground to the highest point of the dish, Said height shall not exceed 15 feet, and the diameter of the dish shall not exceed 10 feet.
Each satellite dish antenna shall be screened from view such that the dish shall not be visible from any street or adjoining or adjacent property from ground level.
Not more than one satellite dish antenna may be erected on any building lot.
No satellite dish antenna shall be constructed, erected or installed except in conformance with all provisions of this Article and only after a building permit is obtained from the borough's Building Office. The application for said permit shall be on such form as prepared by the borough and shall show the proposed compliance with the requirements of this Article, including the owner and address of the property where the satellite dish antenna is to be constructed; the name and address of the company or person installing the satellite dish antenna; a sketch or plan of the satellite dish antenna; a plot plan or survey of the property showing the proposed location of the satellite dish antenna; and the screening details as required by ยงย 150-60 above. Any movable satellite dish antenna which is not permanently ground-mounted in the borough shall also require the issuance of a building permit if such satellite dish antenna or any replacement of the same is to remain within the Borough of Brooklawn for more than 15 days.
The permit fee for the construction or erection of a satellite dish antenna or maintenance of such movable antenna within the borough shall be $25.
This Article shall not be construed to regulate those forms of communication which are federally regulated and require licensing by the federal government through any of its agencies.
