[Adopted 1-1-1982 as Sec. 1-1 of the 1982 Recodification]
For the purpose of this Code, and in the interpretation and application of all other ordinances heretofore or hereafter adopted, except as the context may otherwise require, the following terms shall shall have the meanings indicated:
BOROUGH
The Borough of East Rutherford, in the County of Bergen and State of New Jersey.
BOROUGH COUNCIL or COUNCIL
The Mayor and Council members constituting the governing body of the borough, elected pursuant to law.
CLERK or BOROUGH CLERK
The Municipal Clerk, or Acting Municipal Clerk, duly appointed pursuant to law.
DEPARTMENT
An organization or unit of the borough government established or designated by ordinance as a department, together with any agency or instrumentality of the borough government assigned to such organization or unit by the Borough Council.
EX OFFICIO
That the officer so designated is by virtue of his office automatically a full member of a board or body without need for appointment.
MONTH
A calendar month unless otherwise specifically provided.
ORDINANCE ENFORCER
Any person appointed by the Mayor and Council vested with the power of enforcing borough ordinances. The term "Ordinance Enforcer" shall be used interchangeably with the term "License Inspector" for purposes of this Code.
ORDINANCE or SECTION
Any act of local legislation heretofore or hereafter adopted, including this Code, so long as it shall have been adopted by the procedure required for the adoption of an ordinance and so long as it shall remain in force and effect pursuant to law.
PERSON
Any corporation, firm, partnership, association, organization or other entity, as well as an individual.
YEAR
A calendar year, unless otherwise specifically provided.
For the purpose of this Code and any other ordinances heretofore or hereafter adopted, except as the context may otherwise require:
A. 
The present tense includes the past and future tenses, and the future tense includes the present.
B. 
The masculine gender includes the feminine and neuter genders.
C. 
The singular number includes the plural, and the plural number includes the singular.
D. 
The word "shall" is mandatory and "may" is permissive.
E. 
The time within which an act is to be done shall be computed by excluding the first and including the last day, and if the last day shall be a Sunday or a legal holiday, that day shall be excluded.
F. 
"Writing" and "written" includes printing, typewriting and any other mode of communication using paper or similar material which is in general use, as well as legible handwriting.
G. 
The word "and" shall include the word "or" and the word "or" shall include the word "and."
H. 
Code references. As used in this Code, the following terms shall be construed as set forth:
CHAPTER
One of the major divisions of the recodification, identified by an Arabic number and divided by subject matter.
SECTION
A major subdivision of a chapter.
SUBSECTION
A paragraph under a section of a chapter, identified by a letter or number.
