[Adopted 1-1-1982 as Sec. 2-22 of the 1982 Recodification]
The Department of Borough Ordinance Enforcer is hereby created in and for the Borough of East Rutherford by and subject to the provisions of this article in accordance with the laws of the State of New Jersey. The Officers of the Borough Ordinance Enforcer Department shall consist of a Director and Assistant Director.
The Officers of the Borough Ordinance Enforcer Department shall be appointed by the Mayor with the advice and consent of the Council and shall serve at the pleasure of the Mayor and Council. Said Officers shall only be removed after a determination by the Mayor and Council that just cause exists for such removal, and such Officer shall be removed only by a two-thirds vote of the Borough Council.
The Borough Ordinance Enforcers shall be chosen on the basis of their abilities and qualifications with special regard to any experience in municipal administration or law enforcement. The Borough Ordinance Enforcers must be residents of the Borough of East Rutherford.
The Borough Ordinance Enforcers shall have the following duties, responsibilities and powers:
A. 
To serve as the principal administrative officer regarding the implementation and enforcement of all municipal ordinances, together with any and all county and state codes, rules, regulations and laws.
B. 
Conduct a continuing survey of the various ordinances affecting the municipality and the compliance of the same throughout the municipality and provide reports and recommendations to the Mayor and Council with respect thereto. A written report shall be submitted monthly to the Mayor and Council.
C. 
Provide coordination with the various boards having regulatory ordinances, including but not limited to the Planning Board, Board of Health, Board of Adjustment, Recreation Commission, Shade Tree Commission, Fire Prevention Bureau and such other boards and committees of the municipality as are approved and appointed by the Mayor and Council.
D. 
Supervise the enforcement of all codes affecting the municipality, including zoning, building, property maintenance, public welfare, animal control, health and any and all other codes.
E. 
To direct the compliance with the aforementioned ordinances, codes, rules and regulations and laws and to be empowered to issue summonses or to take any action reasonably required to effectuate such compliances.
This article will not be deemed to supersede any ordinances, rules, regulations or law vesting concurrent powers in members of the Police Department, zoning officers or any other municipal officers, nor shall it be deemed that the Borough Ordinance Enforcer is either subordinate or supervisory to any such officers.
