A. 
The Borough of East Rutherford finds that parking restrictions in designated residential areas are necessary and advisable. Therefore, the Borough hereby establishes this Resident Parking Program.
B. 
The purpose of the East Rutherford Resident Parking Program is to:
(1) 
Reduce hazardous traffic conditions within the residential areas by reducing the commercial, business and commuter traffic.
(2) 
Protect the residential area from air pollution, excessive noise, trash, and refuse caused by the entry of such traffic.
(3) 
Protect the residents from unreasonable burdens in gaining access to their residences.
(4) 
Promote efficiency in the maintenance of those streets in a clean and safe condition.
(5) 
Address a critical parking shortage.
C. 
No vehicle shall be parked on the following streets or parts of streets except pursuant to a permit issued under this article between the hours of 8:00 a.m. through 5:00 p.m. on Monday through Friday, with the exception of holidays.

F. 
No vehicle shall be parked in the Park Avenue Municipal Parking Lot except as may be permitted by Article VII of this chapter.

G. 
Notwithstanding anything to the contrary in this § 285-25, nonresident parking shall be permitted on the east and west sides of Boiling Springs Avenue from Paterson Avenue to Main Street but shall be limited to a maximum of four hours.

H. 
Notwithstanding anything to the contrary in this § 285-25, nonresident parking shall be permitted on the north and south sides of Main Street from Boiling Springs Avenue to Everett Place but shall be limited to a maximum of four hours.

A. 
A residential parking permit of a design specified by the Borough of East Rutherford will be issued to the resident owner of a specific vehicle upon submission of the appropriate application and supporting documents. The permit shall display the permit number, the make, model and color of the vehicle, and the date the permit expires. No permit shall be issued to a vehicle having more than four wheels. The vehicle must be owned by a person residing in the Residential Parking Permit Zone.
B. 
The following proof of residency of vehicle's owner must be presented and approved by the East Rutherford Police Department before a residential parking permit is issued:
(1) 
A copy of a valid New Jersey driver's license for the applicant which, except for leased or company-owned vehicles, reflects an address within the applicable Residential Parking Permit Zone of the Borough.
(2) 
Except for leased vehicles [See Subsection B(5) below] and company vehicles [see Subsection B(6) below], a copy of a valid New Jersey motor vehicle registration for the vehicle for which the permit is sought reflecting an address within the applicable Residential Parking Permit Zone of the Borough.
(3) 
Proof of the vehicle being insured in the State of New Jersey.
(4) 
A current utility or telephone bill with the resident's name and with the same address as described on the driver's license and motor vehicle registration.
(5) 
If the vehicle for which a permit is sought is leased, then a copy of the lease agreement must be exhibited.
(6) 
A resident who requests a residential parking permit for a company vehicle must provide a letter from a reasonable company official, under oath, confirming that the vehicle is assigned to that person.
C. 
The permit is to be displayed on the rearview mirror when the vehicle is parked. The permit shall be removed when the vehicle is in motion.
D. 
A one-time temporary residential parking permit may be issued to a new resident who has not yet changed his or her driver's license, registration or insurance or a resident whose vehicle is stolen or incapacitated and the resident is driving a temporary vehicle. To obtain such a temporary residential parking permit, the resident must show a current copy of his or her utility, telephone bill or lease agreement and, if applicable, must show proof that the vehicle was stolen or incapacitated, together with a valid registration and insurance for the temporary vehicle. The temporary residential parking permit will only be valid for a period of 45 days. The permit must be placed on the driver's side of the dashboard so that a police officer can clearly see and read it. The temporary permit must be returned to the Police Department in order for a new permit to be issued.
E. 
If a person to whom a permit is issued changes his or her resident address but remains a resident of the Borough of East Rutherford, a new permit must be obtained.
F. 
All permits will automatically be revoked if the assigned vehicle ceases to qualify for the Resident Parking Program or if a person ceases to be a resident to whom a permit has been issued of the Borough. If revoked, the permit shall be promptly returned to the East Rutherford Police Department.
G. 
There is no permit fee for any of the permits, except:
(1) 
A fee of $5 will be charged for the replacement of the first lost permit.
(2) 
A fee of $10 will be charged for the replacement of the second and every subsequent lost permit.
A. 
Two residential visitor permits per household may be issued for use by visitors to residents on the streets or parts of streets listed in § 285-25 only while visitors are actually visiting the household to which they were issued. There shall be a rebuttable presumption that any vehicle parked more than one block from the household for which the visitor permit has been issued is not visiting such household.
B. 
The residential visitor permit is to be displayed on the front driver's side dashboard above the steering wheel and must be fully readable from the exterior of the vehicle.
C. 
The residential visitor permit shall be returned to the resident at the conclusion of the visit.
D. 
The residential visitor permit shall be valid for one year from the date of issue. The expired residential visitor permit must be returned to the Police Department before a new one can be issued.
E. 
No residential visitor permit shall be issued to any person residing in any building exclusively used by students and affiliates of a college.

A. 
A commuter parking permit of a design specified by the Borough of East Rutherford will be issued to the resident owner of a specific vehicle upon submission of the appropriate application and supporting documents to the Borough Clerk, together with the fee required by this article. The Borough Clerk shall forward the application to the Police Department.
B. 
The permit shall display the permit number, the make, model and color of the vehicle, and the date the permit expires. No permit shall be issued to a vehicle having more than four wheels. The vehicle must be owned by an East Rutherford resident. The commuter parking permit shall be valid for a period of one calendar month.
C. 
The proof of residency of the vehicle's owner, in accordance with § 285-26B, must be presented and approved by the East Rutherford Police Department before a commuter parking permit is issued.
D. 
The permit is to be displayed on the rearview mirror when the vehicle is parked. The permit shall be removed when the vehicle is in motion.
E. 
A one-time temporary commuter parking permit may be issued to a new resident under the circumstances and in accordance with § 285-26D.
F. 
All permits will automatically be revoked if the assigned vehicle ceases to qualify for a commuter parking permit or if a person ceases to be a resident of the Borough of East Rutherford. If revoked, the permit shall be promptly returned to the East Rutherford Police Department.
G. 
The following fees shall apply to commuter parking permits:
(1) 
A fee of $50 per month will be charged for the issuance of a commuter parking permit.
(2) 
A fee of $5 will be charged for the replacement of the first lost permit.
(3) 
A fee of $10 will be charged for the replacement of the second and every subsequent lost permit.
H. 
Not more than 12 monthly commuter parking permits shall be issued by the Borough of East Rutherford.
A. 
Any business located in a Residential Parking Permit Zone may obtain two business employee permits of East Rutherford for nonresident employees of such business who commute to work by automobile.
B. 
Each business employee permit shall be effective only during the hours of work of the nonresident employee and, in the case of an employee of a school or day-care center, during school events.
C. 
The business employee permit shall contain the information provided in § 285-26 and the hours of work of that employee and shall only be utilized by that employee.
D. 
A business employee permit shall be valid for the shorter of one year from the date of issue or the term of employment of the employee. The expired business permit shall be returned to the Police Department before a new one can be issued.
E. 
There shall be a rebuttable presumption that any vehicle parked more than one block from the business for which the visitor permit has been issued shall not be in the area for business purposes.
A. 
Business visitor permits, in a number determined by the Police Department, shall be issued to doctors, dentists, and lawyers and other professionals (as defined in this Code) upon written request.
B. 
The business visitor permits are not to be used by the applicant's employees, provided that a school/day-care center may apply for visitor permits for substitute teachers.
C. 
All requests for a business employee or a business visitor permit shall be sent on the applicant's business letterhead, and there must be no or, in case of a school or day-care center, limited, off-street parking available in the area of the applicant's place of business.
A new permit must be obtained in the event of change of residency or change of any vehicle or license plate on a previously registered automobile.
A. 
Parking permits will automatically be revoked if a vehicle ceases to qualify, if affixed to a car other than the one so designated at the time of application or if the vehicle registration number on the residential parking permit is different from the one on the vehicle.
B. 
Any vehicle bearing a revoked residential parking permit and parked on a street posted "resident permit only" will be subject to the same penalty as a vehicle parked in that location without a valid permit.
A. 
Permits will be valid for the following periods of time:
(1) 
Temporary permits: 45 days from the date of issue.
(2) 
Visitor permits: one year from the date of issue.
(3) 
Business permit: one year from the date of issue.
(4) 
Resident permits: four years from the date of issue.

B. 
Any vehicle bearing an expired visitor permit and parked on a street posted "resident permit only" will be subject to the same penalty as a vehicle parked in that location without a valid permit.
A. 
Any vehicle parked in violation of the residential parking permit regulations will be subject to a fine of $50.
B. 
Residents in possession of parking permits who misuse them are subject to revocation of the permits for one year and a fine of $100.
C. 
Any person(s) found to possess an invalid, expired or counterfeit residential, temporary, visitor or business permit shall be subject to a fine of $100.[1]

The phrase "Residential Parking Permit Zone" shall mean such street or area upon which parking is permitted only for vehicles displaying a valid permit.
A. 
The Chief of Police shall promulgate administrative rules and regulations for the Resident Parking Program consistent with this article, subject to modification by veto of the Borough Council. No administrative rule or regulation shall be effective unless it is first delivered to the Mayor and Council at least 30 days prior to its effective date.
B. 
The Chief of Police shall ensure that all of the streets listed in § 289-25 are posted with signs in accordance with Manual on Uniform Traffic Control Devices (MUTCD).
