The following code amends, repeals and replaces
a certain code entitled "The Sanitary Code of the Borough of East
Rutherford, Bergen County, New Jersey, introduced and adopted by the
Board of Health, Borough of East Rutherford, Bergen County, New Jersey,
Revision of 1968."
This chapter shall be known and designated as
the "Sanitary Code of the Borough of East Rutherford, Revision of
1973."
A.Â
The words "Board," "the Board," "this Board," "said
Board," and "Board of Health" shall be held to mean the Board of Health
of the Borough of East Rutherford or its official representatives,
except where otherwise specified, when the Board is not in session.
B.Â
The words "Borough," "this Borough" and "the Borough"
shall be held to mean the Borough of East Rutherford.
C.Â
The word "person," as used herein, shall be construed
to import both the singular and plural, the masculine, feminine and
neuter genders, and shall include individuals, partnerships, corporations,
companies, societies and associations. When construing and enforcing
the provisions of this chapter, the act, omission or failure of any
employee, officer, servant, agent or other person, acting for or employed
by an individual, partnership, corporation, company, society or association
within the scope of his employment or office, shall in every case
also be deemed to be the act, omission or failure of such individual,
partnership, corporation, company, society or association, as well
as that of the person.

All masculine pronouns or derivatives thereof shall
be construed as importing the masculine, feminine and neuter genders,
and all feminine pronouns and all derivatives thereof shall be construed
as importing the masculine, feminine and neuter genders.

For the purpose of this chapter, the following terms
shall have the meanings indicated:
The formal written permission to perform certain acts or
carry on a certain business embodied in the document granting such
permission, and shall expire December 31 next, and said license shall
not be transferable.
Temporary permission, in writing, to cover the doing of a
single act, or a series of acts, and to be completed within 30 days
after permission and shall automatically revoke after said time has
expired.
Any place of business, restaurant, lunchroom, cabin, tavern,
barroom, hotel, diner or any other place where food or drink is offered
for sale to the public, and any camp, trailer camp, motel, tourist
home, or buildings to which the public has access and where people
congregate, parks or place of business where toilet facilities or
water for drinking or culinary purposes may be available for use of
the public.
That degree of cleanliness as the Board may demand.
