The Department of Development and Housing will
include those divisions of the Township government and those functions
assigned to the Department by the Township Committee in accordance
with this chapter.
A.
There shall be within the Department of Development
and Housing an Engineer's Office headed by the Township Engineer.
The Township Engineer shall be appointed by the Township Committee
for a term of one year and shall be paid such fees and charges as
shall be fixed by contract or ordinance. The Township Engineer shall
be a duly licensed professional engineer of the State of New Jersey.
The duties of the Engineer shall include the following:
(1)
Provide engineering services to the various departments
and boards of Township government as directed.
(2)
Provide and maintain maps, plans and survey specifications,
surveys and records with respect to all public projects undertaken
by the Township.
(4)
Review all specifications for all capital projects
and review all work done for compliance with specifications.
(5)
Assure compliance with all Township ordinances regarding
road openings.
(6)
Perform such other duties as are assigned by the Township
Committee.
B.
Upon expiration of his term, the Township Engineer
shall surrender to the Township officials charged with the custody
thereof all maps, surveys, plans, specifications, reports and studies
belonging to the Township.
A.
The Township Committee shall appoint a Zoning Officer
for a two-year term who shall perform such duties and functions as
are necessary to enforce the Land Development Ordinance[1] of the Township of Mullica.

B.
The duties of the Zoning Officer shall include but
not be limited to the following:
(1)
Issuance of warnings and/or summonses for violations
of said ordinance.
(2)
Receiving all applications for zoning permits for
construction, alteration or demolition of a use for any building where
such construction, alteration or demolition would be in violation
of any provision of the Land Development Ordinance, and no building
permits or certificates of occupancy shall be issued without a zoning
permit or a certificate of compliance issued by the Zoning Officer.
(3)
Granting of zoning certificates of compliance where
the provisions of the Land Development Ordinance of the Township of
Mullica have been complied with and to make inspections and to examine
plans and specifications.
(4)
Maintaining careful and comprehensive records of all
applications, certificates issued, inspections made and notices and
summonses issued.
(5)
The Zoning Officer is hereby designated the administrative
officer as defined in the Municipal Land Use Act for the Township
of Mullica.
(6)
The Zoning Officer shall further perform such duties
and functions as are necessary for the enforcement of all other ordinances
of the Township of Mullica wherein penalties are provided for the
violation thereof in accordance with the standards and procedures
established by said ordinances, including but not limited to the issuance
of warnings and summonses and the prosecution of violations of said
ordinances in the Mullica Township Municipal Court.
C.
Supervision of the Zoning Officer. The Zoning Officer
shall be responsible to and report to the Director of Development
and Housing.
D.
Compensation. The compensation to be paid to the Zoning
Officer shall be fixed annually by the Township Committee as part
of the Annual Salary Ordinance.
A.
There is
established in the Township a Planning Board consisting of nine members
and two alternates who shall be appointed in accordance with N.J.S.A.
40:55D-23. The Planning Board shall implement and enforce the Township
Zoning Ordinance[1] and shall perform its duties in conformance with the provisions
of the Municipal Land Use Act pursuant to N.J.S.A. 40:55D-1 et seq.
B.
Henceforth
there shall be four alternate members of the Planning Board meeting
the qualifications of Class IV members that are appointed by the Mayor
and designated as, respectively, "Alternate 1, 2, 3 and 4."

Pursuant to the New Jersey Municipal Land Use
Law at N.J.S.A. 40:55D-25, Subdivision c, the Mullica Township Zoning
Board of Adjustment is hereby abolished and the duties and powers
of said Board shall be hereinafter vested in the Mullica Township
Planning Board. The Planning Board shall thus exercise, to the same
extent and subject to the same restrictions, all of the powers of
said Board of Adjustment, but the Class I and the Class III members
shall not participate in the consideration of applications for development
which involve relief pursuant to subsection (d) of Section 57 of P.L.
1975, c. 291 (N.J.S.A. 40:55D-70).
A.
There is established in the Township an Environmental
Commission consisting of five members. In accordance with N.J.S.A.
40:56A-1, the members shall be appointed by the Mayor who shall also
designate one of the members to serve as Chairman and presiding officer
of the Commission. Terms of office of the Commissioners shall be for
three years, except that the initial appointments shall include one
member who shall serve for one year, two members who will serve for
two years and two members who will serve for three years.
B.
The Commission shall serve in an advisory capacity
to the Township Committee, the Planning Board and the Board of Adjustment.
The Secretaries of the Planning Board and the Board of Adjustment
shall make available to the Commission an informational copy of every
application for development submitted to either Board.

A.
There is
established in the Township an Economic Advisory/Development Commission.
One member of the Economic Advisory/Development Commission will be
the current Director of the Department of Development and Housing.
The other six members will be a resident, property owner or business
proprietor of the Township, appointed by the Mayor, with the consent
of the Township Committee. Membership shall be for three-year terms
that are evenly staggered. The Chairperson and Co-chairperson of the
Commission will be appointed annually at the first meeting of the
year, following the Township Committee Reorganization meeting, by
vote of the Commission members.

objectives of the Economic Advisory/Development Commission are to:

The Economic
Advisory/Development Commission will make recommendations to the Township
Committee with regard to efforts, programs and initiatives that benefit
the residents economically, that protect and retain the rural character
of Mullica’s Pinelands municipality, are compatible with the
Pinelands Commission’s Comprehensive Management Plan and use
the current Land Use Code as a guideline. Its duties include seeking
ways to attract new, community-friendly businesses to the Township
within the Pinelands Town and Village Centers, seeking ways to promote
ecotourism in the Township, advising and assisting in the rehabilitation
and revitalization of brownfields, researching and advising the Committee
on opportunities to obtain resources to make the Elwood Village Center
and the Pinelands Town along Route 30 attractive destinations to promote
appropriate commercial and light industry businesses, working with
existing business owners and those applying for new businesses, and
working on its various initiatives with the consultation of the Township
Committee.
D.
Regular
updates from the meetings shall be brought to the Township Committee
by the Director of Housing and Planning.
