Hereafter, each and every person owning, harboring, keeping or having charge of any animal as described in Article I of this chapter shall:
A. 
Prevent such animal from running at large upon any public highway, street, alley or park or private property without the consent of the owner thereof or upon any other place in said Township at any time.
B. 
Prevent any such animal from injuring or damaging any vegetable garden, flower garden, lawn, plant, tree, shrubbery, grounds or other personal property of any person other than the person owning, harboring, keeping or having charge of said animal.
Hereafter, each and every person owning, harboring, keeping or having charge of any licensed or unlicensed male or female dog shall:
A. 
Prevent such dog from being on any public highway, street, avenue, alley, park or other public place in the said Township at any time unless such dog is accompanied by a person and securely confined and controlled by an adequate leash not more than six feet in length.
B. 
Prevent such dog from worrying, wounding or killing any sheep, lamb, domestic animal or poultry of any person other than the person owning, harboring, keeping or having charge of such dog.

The Township Council of the Township of Mullica shall appoint, pursuant to N.J.S.A. 4:19-15.16b a certified Animal Control Officer who shall be responsible for animal control within the jurisdiction of the municipality and who shall enforce and abide by the provisions of Section 16 of P.L. 1941, c. 151 (N.J.S.A. 4:19-15.16).

Any licensed or unlicensed male or female dog that shall be found running at large upon any public highway, street avenue, alley, park or other public place in said Township at any time, doing any of the other things mentioned in §§ 79-2 and 79-3 of this chapter and which the person owning, harboring, keeping or having charge of such dog is required by this chapter to prevent shall forthwith be taken and impounded by the Animal Control Officer of the said Township and shall be kept and confined for a period of five days next thereafter, and shall then be humanely destroyed or otherwise disposed of according to law; provided, however, that within said period of five days the Animal Control Officer of the said Township shall release such dog to the owner thereof upon claim therefor and upon payment to the said Animal Control Officer of the amount for expenses, costs and fees which amount shall be enumerated in the contract entered into between the Animal Control Officer and the Township pursuant to all the requirements of N.J.S.A. 40A:11-1 et seq.

Any animal as described in Article I of this chapter, with the exception of dogs, which is found running at large on any public street, highway, avenue, alley, park or other public place in said Township at any time doing any of the things mentioned in § 79-2 of this chapter which the person owning, harboring, keeping or having charge of said animal is required by this chapter to prevent shall be treated for all purposes pursuant to the provisions of § 79-4 of this chapter and shall forthwith be taken and impounded by the Animal Control Officer of said Township and shall be kept and confined in an appropriate place for a period of not less than five days after such impoundment and the owner, if known, shall be given notice of the impoundment. Should the owner of any such animal other than a dog claim said animal within said five-day period and pay said animal control officer an amount for expenses, costs and fees which amount shall be enumerated in the contract entered into between the Animal Control Officer and the Township pursuant to all the requirements of N.J.S.A. 40A:11-1 et seq., then said Animal Control Officer of said Township shall release such animal to the owner thereof upon his making claim therefor.

Any person who shall violate any of the terms or provisions of this chapter or do any act or thing therein prohibited or neglect, fail or refuse to do any act or thing required to be done shall, upon conviction thereof before the Municipal Court of the Township of Mullica, forfeit and pay such fine of not less than $20 but not exceeding the sum of $50 or be imprisoned in the county jail for such term not exceeding 60 days or not more than 30 days' community service as the Municipal Court of the Township of Mullica shall determine; provided, however, that the Municipal Court of the Township of Mullica shall have the power in its discretion to impose a sentence of both fine, community service and imprisonment not exceeding the maximum limits herein fixed.
