There shall hereby be established in the Township of Mullica a recreation fee. Said fee shall be established through the office of the Chief Financial Officer. The fee shall be in an amount as set forth in this article and collection shall be pursuant to this article. Any funds collected pursuant to this article shall be identified as miscellaneous revenue and be placed in the Township's general fund.
Every effort shall be made so that any fees collected pursuant to this article shall be expended only for use concerning the construction, repair, maintenance, and creation of recreation facilities within the Township of Mullica.
A reasonable relation and proportionality exists between this article, the fee established hereby and the goal it attempts to accomplish. A simple nexus is that increased population growth within the Township will inevitably lead to the expansion of recreation facilities within the Township. Therefore, new houses being constructed within the Township should pay an initial pro rata share for the cost of such expansion and maintenance of the recreation facilities within the Township.
There is hereby established a fee of $75 for each new residential dwelling constructed within the Township of Mullica. Said fee shall be payable at the time of application for a building permit and shall be payable in a separate check in said amount made payable to the "Township of Mullica." For the purposes of this article, a residential dwelling shall be considered any dwelling whether attached or detached which houses living quarters. For example, a detached single-family home shall be considered one dwelling unit pursuant to this article. A duplex shall be considered two dwelling units.
The formula used to arrive at the above-mentioned fee is as follows:
The estimated cost as determined by the Recreation Committee for the Township of Mullica for recreation improvement, expansion and maintenance during the five-year period immediately subsequent to the adoption of this article equals

Said $72.78 figure was rounded up to $75.00 per residential dwelling.
Two years after this article takes legal effect, the Committee of the Township of Mullica shall reevaluate this article to make an appropriate adjustment in the calculation of this Recreation Fee Ordinance to make an appropriate adjustment in the recreation fee. Consideration shall be given to the amount of growth within the Township, the expansion and maintenance of recreation facilities within the Township.
