A. 
There is hereby created the office of Superintendent of the Department of Public Works of the Township of Rochelle Park, County of Bergen and State of New Jersey.
B. 
The Superintendent of the Department of Public Works shall be appointed by the Township Committee and shall, at all times, serve at the pleasure of the Township Committee.
C. 
Pursuant to the provisions of N.J.S.A. 48:9-154:6, tenure in said office is hereby authorized upon completion of five years in the position; provided, however, that the Township Committee adopts a resolution upon completion of five years of service authorizing and granting tenure in the position.

The Superintendent appointed pursuant hereto shall supervise the operation of the sewer pumping station and attend to the care and operation of same and perform such other duties and such other work in connection with the Department of Public Works of the Township of Rochelle Park as the Township Committee may from time to time direct by resolution.

A. 
The Superintendent of the Department of Public Works shall supervise the erection and construction of all new roads, the repair and alteration of existing roads and the removal of snow from said roads, have charge of any and all street openings, be in charge of cleaning said roads and all appurtenances thereto, such as storm drains and sanitary sewer lines, and perform such other duties and do such other work in connection with the roads as the Township Committee may from time to time direct.
B. 
Traffic control in construction and maintenance zones.
(1) 
Purpose. The Township Committee hereby finds and declares that problems of traffic control occur when traffic must be moved through or around road or street construction, maintenance operations and utility work above or below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through construction and maintenance zones and to provide safety for the workforces performing these operations.
(2) 
Adoption of Manual on Uniform Traffic Control Devices ("MUTCD"). The Township of Rochelle Park in the County of Bergen, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices, hereafter known as "MUTCD" as may be supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility which fails to comply with the provisions of MUTCD while performing such work is in violation of this section.
(3) 
Preconstruction meeting. It shall be the responsibility of the person, contractor, or public utility wishing to conduct work on, under or above the roadway to contact the Traffic Bureau and the Chief of Police of the Rochelle Park Police Department in order to arrange a preconstruction meeting to submit plans for the safe movement of traffic during such period of construction or work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Traffic Bureau and Chief of Police of the Rochelle Park Police Department is in violation of this section. Public utilities conducting routine maintenance work need not comply with the preconstruction meeting requirement. A valid road opening permit from the Township (see § 31-3) or Bergen County shall be provided at the preconstruction meeting. Proof of utility mark out notification is required at the preconstruction meeting.
(4) 
Emergency contact telephone numbers. The person, contractor or utility shall provide the Traffic Bureau and Chief of Police with at least two emergency contact phone numbers to be called in case of emergency problems at any construction or maintenance site prior to the start of any work. If, for any reason, emergency contacts cannot be reached or if the emergency contact person does not respond to a call from the Police Department to correct a hazardous condition, the Township may respond to correct such hazardous condition. The reasonable fees for such emergency services by the Township shall be charged to the person, contractor or utility responsible for such condition.
(5) 
Heavily traveled roads. The Rochelle Park Police Department Traffic Bureau shall maintain a list of all roads determined to be heavily traveled for the purposes of this article. This determination shall be made by the Police Department Traffic Bureau and shall be binding. Said list may be amended from time to time as conditions warrant to include roads which become heavily traveled due to temporary conditions or events. This list shall be available for inspection during normal business hours, and a copy shall be provided upon request of any party.
(6) 
Time limits. Except as otherwise set forth herein, there shall be no construction, maintenance operations or utility work, under or above any heavily traveled roadway, as defined in this article, in the Township between 7:00 a.m. to 9:00 a.m. or between 4:00 p.m. to 6:00 p.m., unless approved by the Chief of Police or his designee. This time limit may be adjusted to permit work during the restricted hours set forth in Subsection B(6) by the officer in charge of the Traffic Bureau of the Rochelle Park Police Department. If it is determined by the officer in charge of the Rochelle Park Police Traffic Bureau, in his reasonable discretion, that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. on any roadway would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. to 4:00 p.m.
(7) 
Road closings and detours. Road closings and/or traffic detours shall not be permitted unless approved by the Rochelle Park Police Chief or the Traffic Bureau Commander.
(8) 
Use or assignment of police officers. The use or assignment of police officers by utility companies, private contractors and other vendors for traffic control details shall be compensated at the officer's off duty detail rate or overtime rate, whichever is higher, with an additional administrative fee of 28%. A vehicle fee of $20 per hour per patrol car shall also be charged and payments made as per § 28-16.1 Reimbursement by private contractors.
(a) 
Officers assigned to a traffic control or road construction detail for a utility company, private contractor or other vendor shall receive a minimum compensation of four hours. Details exceeding the originally scheduled hours shall be compensated at a minimum of two-hour increments until the completion of the detail.
(b) 
All cancellations by either party require 24 hours written notice. If an in the event cancellation occurs less than 24 hours but more than eight hours prior to the scheduled commencement time for the services, the contractor agrees to pay two hours per man for the cancellation at the scheduled assignment rate. If and in the event the cancellation occurs less than eight hours prior to the commencement time for services, the Contractor agrees to pay four hours per man.

A. 
There is hereby established within the Department of Public Works a Division of Recycling under the direction of the Recycling Coordinator.
B. 
The Recycling Coordinator shall be under the supervision and authority of the Superintendent of the Department of Public Works and shall have the following duties:
(1) 
Establish, perform and publicize educational programs in furtherance of the township's anti-littering and recycling efforts.
(2) 
Coordinate various industrial, business, civil and volunteer organizations to aid in the township's anti-littering and recycling efforts.
(3) 
Act as liaison between the township and state and county anti-littering and recycling programs.
(4) 
Recommend to the Township Committee the adoption of resolutions and ordinances, as appropriate, to carry out the township's anti-littering and recycling efforts.
(5) 
Encourage and cooperate with all local voluntary and state and county anti-littering and recycling programs to focus public attention on the township's anti-litter and recycling programs.
(6) 
Investigate and report to the Township Committee on the availability of funds from any private or public sources to be used in the township's anti-littering and recycling efforts.
(7) 
Upon the approval or at the direction of the Township Committee, apply for funds from any private or public sources to be used in the township's anti-littering or recycling efforts.
(8) 
Investigate and report to the Township Committee any successful methods of anti-littering, litter pickup and removal or recycling programs in other municipalities and in other states and evaluate their possible incorporation into the township's anti-littering and recycling efforts.
(9) 
Identify and investigate and report to the Township Committee all potential locations and markets for the disposal or sale of recyclables, including leaf disposal.
(10) 
Subject to the approval of the Township Committee, assist the Township Attorney in the negotiation of contracts for the disposal or sale of recyclables, including leaf disposal.
(11) 
Compile, prepare and submit recycling tonnage reports to the New Jersey Office of Recycling in accordance with rules and regulations adopted by the Department of Environmental Protection therefor and to the Bergen County Utilities Authority.
(12) 
Pursuant to § 112-15D of the Rochelle Park Code, prepare an annual registration form and semiannual recycling collection forms for use by the owners, lessees and/or occupants of all commercial and/or industrial property in the township and compile and maintain said forms.
(13) 
Receive and handle complaints and inquiries from the public respecting the anti-littering and recycling efforts and report thereon to the Superintendent of the Department of Public Works.
(14) 
Perform such other duties as may be required by law or from time to time prescribed by the Township Committee.

A. 
There is hereby established within the Department of Public Works a Division of Shade Trees under the direction of the Superintendent of the Department of Public Works.
B. 
Subject to regulations adopted by the Township Committee, the Superintendent of public Works shall be responsible for the care, maintenance, planting and removal of shade and ornamental trees and shrubbery now located or which may hereafter be planted in any public street, park or public place within the Township of Rochelle Park, other than that which is within the jurisdiction of the New Jersey Department of Transportation or the County of Bergen.
C. 
In the event that a residential property owner believes that a tree located within the municipal right-of-way should be removed or trimmed (only diseased, trees that are not viable or dead trees, trees trimmed by utility companies that are not viable and trees that extend beyond the curb line will be removed) the residential property owner shall file a formal notice/complaint with the Department of Public Works Superintendent on the form available in the office of the Township Clerk. Said form shall be sent to the office of the Township Clerk who shall forward the same to the Superintendent of the Department of Public Works .
D. 
The Department of Public Works Superintendent shall consult with the Township's arborist in order to determine the best course of action with regard to the tree in question. If the recommendation is for the tree to be removed, the municipality shall arrange to remove the tree in question between the months of April and October, subject to availability of funds. The resident to the abutting property shall be notified at least one week prior to the work being performed.
E. 
The property owner will be consulted with regard to a replacement tree and if the property owner desires a new tree be planted, the municipality will arrange to do so, subject to the availability of funds and subject to the following conditions:
(1) 
A "tree planting list" will be maintained by the office of the Township Clerk. All reasonable efforts will be made to replace the tree within three calendar months of its removal;
(2) 
All new trees must be planted within the Township's right-of-way and/or easement area as set forth on the tax map.
F. 
If the written recommendation of the Department of Public Works Superintendent, in consultation with the arborist, does not suggest the removal of the tree, the abutting property owner at his or her own expense may remove the tree and stump upon receipt of a written letter of approval from the Township Administrator. The resident must, thereafter, plant a replacement tree on their property or pay the tree replacement fee of $175.
G. 
Trimming. If a property owner, the Department of Public Works Superintendent or arborist suggest trimming of branches, a list shall be established by the Township Clerk and the trimming will be addressed in order of receipt of request and exigency of trimming.
