[HISTORY: Adopted by the Town Board of the Town of Bethel as Ch. 3 of the 1979 Code (Ch. 4 of the 1990 Code). Amendments noted where applicable.]
The purpose of this chapter is to authorize public servants of the Town of Bethel, Sullivan County, New York, to issue and serve appearance tickets in connection with the violation of state statutes and local laws, ordinances, rules and regulations of the Town of Bethel which the public servants are authorized or required to enforce.

The following public servants of the Town of Bethel are hereby authorized to issue and serve an appearance ticket with respect to violations of a state statute or local law, ordinance, rule or regulation of the Town of Bethel that such public servants are, respectively, required or authorized to enforce:
A. 
Code Enforcement Officer: violation of any provision of Part II of the Code (except for violations of Chapter 104, Boating and Watercraft; Chapter 231, Parking; and Chapter 325, Vehicles and Traffic), including but not limited to the following:
(1) 
Building, including but not limited to the New York State Uniform Fire Prevention and Building Code.
(2) 
Zoning.
(3) 
Planning.
(4) 
Fire prevention and safety.
(5) 
Sewage and health violations, including but not limited to the New York State Sanitary Code.
(6) 
Licensing of occupations or businesses as may be regulated by the Town of Bethel.
B. 
Constables:
(1) 
Violations of Chapter 231, Parking, of the Code.
(2) 
Violations relating to public health, safety and welfare, including but not limited to violations of Code Chapter 83, Animals; Chapter 104, Boating and Watercraft; and Chapter 325, Vehicles and Traffic.
C. 
Animal Control Officer: violations of Chapter 83, Animals, of the Code.
D. 
Navigation assistant - seasonal: violations of Chapter 104, Boating and Watercraft, of the Code.

An appearance ticket, other than one issued for a traffic infraction relating to parking, must be served personally, except that an appearance ticket issued for the violation of a local zoning ordinance or local zoning law or of a building or sanitation code may be served in any manner authorized for service under § 308 of the Civil Practice Law and Rules.
