As used in this chapter, the following terms
shall have the meanings indicated:
ACTIVE PLUMBING LICENSE
A license issued yearly by the Building Department with a
commencement date of January 1 and an expiration date of December
31 of the same year and renewed on a yearly basis, which license shall
be considered revoked if not renewed for a period of three consecutive
years.

No person, firm, partnership or corporation
shall engage in or conduct the trade or business of plumbing within
the Town of Brighton without first having obtained a license therefor
issued by the Building Department and without having first obtained
and filed with the Building Department an insurance certificate as
provide for in Subsection D of this section. Such license shall be
issued on forms provided by the Building Department and at an annual
fee set by resolution of the Town Board and filed in the Building
Department. No person shall sell, lend, rent or in any manner transfer
or assign a license or license number to any other person, nor shall
a person make use of a license, name or license number to which the
person is not entitled.

The Commissioner of Public Works or designee
may issue a license to any applicant holding a license issued by the
Examining Board of Plumbers of the City of Rochester, New York.

A corporation or limited-liability company may
conduct the trade within the Town of Brighton and shall be entitled
to a license therefor, provided that one or more employees of such
entity are the holders of a license, duly granted as provided in this
chapter. No person shall perform the trade on behalf of such entity
unless he or she is licensed hereunder.

An insurance certificate showing coverages set
by resolution of the Town Board and filed in the Building Department
shall be filed by every person or corporation engaged in the trade
or business of plumbing within the Town of Brighton and shall be filed
in the Building Department before the license shall be issued. Such
insurance certificate shall name the Town of Brighton as an additional
insured. Such insurance certificate shall be renewed from year to
year so long as the licensee engages in or does plumbing in said Town.
The Town Board may revoke any license issued
under the authority of this chapter, provided that before such revocation
a public hearing shall be held thereon and that the Town Board determines
thereafter that such licensee is incapable of properly conducting
the trade or business of plumbing. Any violation of the New York State
Uniform Fire Prevention and Building Code shall be sufficient grounds
for the revocation of such license, but shall not be held to be the
exclusive grounds for such revocation.

A license may be refused or revoked if the applicant is incapable of conducting the trade or business of plumbing. A license shall also be refused or revoked if a person, firm, partnership or corporation has not maintained an active license with the Town for a period of three consecutive years. At the end of the three-year period, a person, firm, partnership or corporation may requalify for a license as outlined in §
125-3 of this chapter. Any applicant who has been refused such license by the Commissioner of Public Works or designee may appeal to the Town Board from such refusal, and such license application may be approved or refused by the Board, notwithstanding the action of the Commissioner of Public Works or designee.

All plumbing installations by the owner shall
comply with the requirements of the New York State Uniform Fire Prevention
and Building Code, and in such event, the word "owner" shall be substituted
for the word "plumber." Persons doing work on their own private plumbing
system are not required to file an insurance certificate, provided
that such work is done in a single-family dwelling.
Public service corporations and their employees,
while engaged in the work of such corporations, are not subject to
the requirements of this chapter.

Persons convicted of violating any provision of this chapter shall be subject to the penalties provided in Chapter
1, General Provisions. Each day a violation continues shall constitute a separate offense.
