This chapter shall be known and may be cited as the "Garbage and Maintenance of Private Property Law of the Village of Bronxville, New York."

A.
Every owner of vacant property and every owner, tenant, occupant or leaseholder of occupied property shall cut, trim or remove brush, grass, weeds, debris, rubbish or other materials upon the property owned or occupied by such owner, tenant, occupant or leaseholder.
B.
Every owner of vacant retail property shall keep the inside premises broom clean and all windows shall be kept free of garbage bags, paper or other material used as window covering.
C.
No material shall be placed at the street for collection prior to 9:00 p.m. the day preceding the scheduled collection.
D.
The exterior of every structure or accessory structure, including signs, fences and awnings, shall be maintained in good repair, free of any condition that would present a safety or fire hazard or adversely affect adjoining properties in the neighborhood, to that end all surfaces thereof shall be kept painted or otherwise provided with a protective coating sufficient to prevent structural deterioration and to maintain a reasonably good appearance. The same shall be maintained free of broken glass, loose shingles, crumbling stone or brick, excessive peeling paint or other conditions reflective of deterioration or inadequate maintenance.
E.
In the event of such person's failure to comply with the requirements of Subsections A through D, the Village Administrator shall give notice to such person requiring compliance within seven days. If the owner of such property is a nonresident, such notice shall be addressed to his or her last known address.
F.
After seven days from the date of mailing of such notice, compliance lacking, the Village Administrator is authorized and directed to cut, trim and remove brush, grass, weeds, debris, rubbish or other materials from any property upon which the same shall be, and the cost thereof shall be assessed against such real property and shall constitute a lien against such property and shall be collected by the Village Treasurer, in the manner provided by law for the collection of delinquent taxes. Such costs shall be in addition to any penalty assessed under § 252-7.
Every owner, tenant, lessee, occupant and superintendent or person in charge of occupied property within the village shall maintain containers of galvanized metal or other durable and nonflammable material for the storage of garbage. The placing of garbage in pasteboard or wooden boxes or in barrels or in cartons or bags is prohibited. Each such container shall be equipped with adequate handles and shall be provided with a tight-fitting cover of galvanized metal or other durable and nonflammable material. Garbage will not be collected from any container which exceeds 20 gallons or 75 liters in capacity.
Upon the publication of a notice by the village that the following provisions are effective, it shall be required that:

Unburnable materials such as ashes, metal cans, bottles or other similar materials shall not be placed in containers with garbage, but shall be kept in covered containers which shall not exceed 20 gallons or 75 liters.
B.
Combustible materials other than garbage such as paper, cardboard, wrappings and other similar material shall not be placed in containers with garbage but shall be consolidated in bundles or kept in containers not exceeding five cubic feet in bulk.
Garbage and other waste materials shall be kept in containers which shall be tightly covered at all times. The space about the containers shall be at all times kept clear of debris or spillage and maintained in a sanitary manner. The Superintendent of Public Works shall prohibit the use of containers and related accessory devices which in his or her judgment may be a clear hazard to public safety.
Persons violating all or any part of §§ 252-3 through 252-5 shall not be entitled to the removal by the village collectors of garbage or other waste material until the conditions constituting the violation are fully corrected by such person. Accumulation of garbage or other waste material as a result of any violations shall be removed at the expense of the person concerned by the village.
Any person violating any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine of not more than $250 or to imprisonment for not more than 15 days, or to both such fine and imprisonment.
