[HISTORY: Adopted by the Town Board of the Town of New Berlin 12-18-1995 by L.L. No. 7-1995. Amendments noted where applicable.]
The Town Board of the Town of New Berlin recognizes that it is desirable to hire employees who are residents of the Town. The Town Board further recognizes that the most qualified candidates may not always be residents of the Town of New Berlin. Therefore, it is in the best interests of the Town of New Berlin that nonresidents be permitted to work as employees of the Town of New Berlin in specific appointed positions.
The authority for the Town Board of New Berlin to appoint nonresidents as employees lies in § 10, Subdivision 1d(3), of the Municipal Home Rule Law.

The position of Town Police Officer may be filled by a resident of the Town of New Berlin, or a resident of the County of Chenango and adjoining counties, as well as Herkimer and Oneida Counties.

The duly appointed Town Highway Superintendent of the Town of New Berlin may reside within any Town that borders the Town of New Berlin.
