That certain document, one copy of which is on file in the office of the Borough Secretary of the Borough of Silverdale, being marked and designated as the “BOCA National Plumbing Code, Seventh Edition, 1987, " as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Plumbing Code of the Borough of Silverdale, in the State of Pennsylvania, for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Plumbing Code are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions and changes, if any, prescribed in § 140-6 of this article.
The code is modified and amended in the following respects:
A. 
Whenever the words "name of jurisdiction" appear in brackets in the code, the words "Borough of Silverdale" shall be inserted in place of those bracketed words. Likewise, the words "Borough of Silverdale" shall be substituted for the word "jurisdiction" where it appears singly in the code without being followed by the words "under the."
B. 
The term "chief appointing authority of the jurisdiction," and the term "chief authority of the jurisdiction," as used in the code, shall mean the Borough Council.
C. 
The term "legal officer of the jurisdiction," as used in the code, shall mean the Borough Solicitor.
D. 
The word "department," and the term "department of plumbing inspection," as used in the code, shall mean and refer to the office of the Plumbing Inspector.
E. 
The term "code official," as used in the code, shall mean and refer to the Plumbing Inspector.
F. 
Section P-104.1 is amended to read as follows:
P-104.1 Continuation. The legal use and occupancy of any structure existing before the effective date of the ordinance adopting this code, or which had been approved before that effective date, may be continued without change except as may be specifically covered in this code or deemed necessary by the Plumbing Inspector for the general safety and welfare of the occupants and the public.
G. 
Section P-109.2 is amended to read as follows:
P-109.2 Appointment of Plumbing Inspector; Acting Plumbing Inspector. The Plumbing Inspector shall be appointed by Borough Council in the same manner as the appointment of other appointed Borough officers or employees. During the temporary absence or disability of the Plumbing Inspector, Council shall designate an Acting Plumbing Inspector.
H. 
Section P-114.2 is amended to read as follows:
P-114.2 Fees. The fees for plumbing permits shall be as set forth in a fee schedule adopted by ordinance or resolution of Borough Council.
I. 
Section P-117.4 is amended to read as follows:
. . . shall be guilty of a summary offense, punishable by a fine of not less than $50 nor more than $1,000 or by imprisonment not exceeding 30 days, or both such fine and imprisonment. Each day that a violation continues shall be deemed a separate offense.
J. 
Section P-118.2 is amended to insert in the two bracketed spaces for dollar amounts "$50" and "$1,000," respectively.
K. 
Subsections P-122.1 through P-122.6 are deleted in their entirety, and the following new Section P-122.1 shall be inserted:
P-122.1 Application for appeal. A Board of Appeals, which shall be composed of the Borough Council, ex officio, is hereby established. The Board of Appeals shall have the duty, responsibility and authority to decide the matters referred to it under this Plumbing Code.
Any owner of a building or structure or any other person who is aggrieved with a decision of the Plumbing Inspector refusing to grant a modification of the provisions of this code covering the manner of construction or materials to be used in the erection, alteration or repair of a plumbing system may appeal the matter, in writing, to the Board of Appeals. Application for appeal may be made when it is claimed that the true intent of this code or the rules legally adopted under this code have been incorrectly interpreted, the provisions of this code do not fully apply, or an equally good or better form of construction can be used.
The appeal must be made to the Secretary of the Borough of Silverdale, in writing, within 30 days of the rendering of the decision of the Plumbing Inspector.
L. 
The code is amended to add the following new section directly following Section P-122.7:
SECTION P-123.0 REGULATION OF PLUMBERS
P-123.1 Registration of plumbers. No person, firm or corporation shall engage in the practice of plumbing within the Borough (unless excepted by this code) unless technically qualified to perform such plumbing activities in a competent manner. Such technical qualifications shall be demonstrated by the person, firm or corporation by the submission of the following information to the Plumbing Inspector:
A statement describing the training course or courses satisfactorily completed.
A statement adequately describing the work experience of the person, firm or corporation.
A statement describing any plumbing licenses received from the state, county, or any other municipality.
Each application shall be submitted with the appropriate nonrefundable fee as set forth in a fee schedule adopted by ordinance or resolution of Borough Council.
The application shall be reviewed and, if deemed necessary, investigated by the Plumbing Inspector, and the Plumbing Inspector shall be authorized to approve or disapprove of the application. All registrations expire on December 31, and each plumber registered must renew his registration annually and submit the required renewal fee. Any registrations not renewed within 13 months of expiration shall be treated as an application for new registration.
The above provisions for the registration of plumbers shall not apply to any person who applies for a permit to do any work regulated by this code in a family dwelling unit owned by him and used exclusively for living purposes, including the usual accessory buildings and quarters in connection with that dwelling, provided that the dwelling will be occupied by that owner and that owner shall personally purchase all material and perform or supervise all labor in connection with the work. This exception to the provisions of the regulations shall not apply in cases involving the connection of water and sewer mains.
M. 
Section P-303.2 is amended to read as follows:
P-303.2 Public systems available. A public water main or public sewer system shall be considered available wherever there is a public water main or a public sewer abutting the property in question within the distance specified by the laws of the Commonwealth of Pennsylvania.
N. 
Section P-308.3 is amended to add as follows:
Water service piping and sewers shall be installed below recorded frost penetration, but not less than three feet below grade.
O. 
Section P-308.4 is amended to add as follows:
. . . shall be a minimum of 36 inches below finished grade at the point of septic tank connection. Building sewers shall be a minimum of 12 inches below grade.
P. 
Section P-308.5 is amended to read as follows:
P-308.5 Trenching and bedding. Trenches shall be of sufficient width to permit proper installation of the pipe. Where shoring is required, ample allowance shall be made in trench width for proper working conditions. Trenches shall be excavated below grade such that the bottom of the trench does not form the bed for the pipe, and the trench shall be backfilled to grade with at least six inches of No. 2 stone placed in layers of six inches' maximum depth and compacted after each placement. Where rock is encountered in trenching, it shall be removed to a point at least six inches below the grade line of the pipe, and the trench shall be backfilled to grade with No. 3 stone tamped in place so as to provide a uniform bearing for the pipe between joints. Care shall be taken so that the pipe does not rest on rock at any point, including the joints. If soft materials of poor qualities are found at the bottom of the trench, stabilization shall be achieved by overexcavating at least two pipe diameters and filling to grade with No. 2 stone or a concrete foundation. Pipe placed on concrete foundation shall be bedded with stone tamped in place so as to provide a uniform bearing for the pipe between joints.
Q. 
Section P-308.7 is amended to read as follows:
P-308.7 Backfilling. Pipe shall be backfilled with No. 2 stone until the crown of the pipe is covered by at least one foot and then lightly tamped. Loose earth, free of rocks, broken concrete, frozen chunks and other rubble, shall be placed in the trench in six-inch (152 mm) layers and tamped in place. The backfill under and beside the pipe shall be compacted for pipe support. Backfill shall be brought up evenly on both sides of the pipe so that it retains alignment.
R. 
Article 3 is amended to add the following new section directly after Section P-312.1:
P-313.0 INTERCONNECTIONS
P-313.1 Interconnection of floor, subsoil, roof and stormwater drains with sanitary sewage drainage. Under no condition shall subsoil drains, roof drains, stormwater drains or floor drains collecting surface water or groundwater be connected to the sanitary sewage system. Under no conditions shall sanitary sewage be connected to the subsoil or storm waste drainage system.
S. 
Section P-601.2.1 is amended to read as follows:
Section P-601.2.1 Diameter of pipe. Any portion of the drainage system installed underground or below a basement or cellar shall not be less than three inches in diameter. In addition, the building sewer shall not be smaller than four inches in diameter for two or fewer households and six inches in diameter for three or more households.
T. 
Section P-604.2 is amended by adding the following sentence:
Sanitary sewage shall not be discharged to the same sewer as stormwater or groundwater.
U. 
Section P-710.1.2 is amended to read as follows:
P-701.1.2 Potable clear water waste. When devices and equipment such as sterilizers, lawn-sprinkling systems and relief valves discharge potable water to the building drainage system, the discharge shall be through an indirect waste pipe by means of an air gap, provided that no waste from swimming or wading pools, including pool drainage, backwash from filters and water from floor drains which serve walks around pools shall be discharged into the sanitary sewer system.
V. 
Article 16 is deleted in its entirety, and in place of it the Borough incorporates by reference the Rules and Regulations of the Pennsylvania Department of Environmental Protection pertaining to Individual Water Supply.
W. 
Principle No. 6 in Appendix B is deleted, and in its place the Borough incorporates by reference the applicable provisions of the Borough Sewer Rate and Sewer Connection Ordinances, as amended.[1]

X. 
The permits and fees required under the provisions of this code shall not apply to any activity having a cost of less than $100, except that any connection to the sanitary sewer must have a permit.
Nothing in this article or in the Plumbing Code adopted by this article shall be construed to affect any suit or proceeding pending in any court or any rights acquired or liability incurred or any cause or causes of action accrued or existing under any prior ordinance wholly or partially repealed or superseded by this article, nor shall any legal right or remedy of any character be lost, impaired or affected by this article.
