Silverdale Borough is divided into zoning districts,
as specified below. Every parcel of land and every building or other
structure in the Borough, except as otherwise provided by law or by
this chapter, shall be subject to the regulations, restrictions, and
requirements specified for the district in which it is located.
For the purpose of this chapter, the Borough
is hereby divided into districts, which shall be designated as follows:

Said districts are bounded and defined as shown
on the map entitled "Zoning Map of Silverdale Borough," which, together
with all explanatory matter thereon, is hereby made a part of this
chapter.
If, in accordance with the provisions of this
chapter, changes are made in the district boundaries or other matters
portrayed on the Zoning Map, such changes shall be made on the Zoning
Map within 30 days after the Borough Council has approved the amendment.
No changes of any nature shall be made in the Zoning Map or matters
shown thereon except in conformity with the procedures set forth in
this chapter.
Where uncertainty exists as to the district
boundary line shown on the Zoning Map, the following rules shall apply:
A. Boundaries that appear to approximately follow the
center line of a street, highway, or alley shall be construed to follow
such center line.
B. Boundaries that follow plotted lot lines shall be
construed as following such lot lines. Where district boundaries are
extensions of lot lines or connect the intersection of lot lines,
such lines shall be said district boundaries.
C. Boundaries that appear to approximately follow a municipal
boundary line shall be construed as following municipal limits.
D. Boundaries that appear to approximately follow the
center line of streams or other bodies of water shall be construed
as such center line.
E. Boundaries that are parallel to or extensions of features indicated in Subsections
A through
D above shall be so construed.
F. Where physical or cultural features existing on the
ground are at variance with those shown on the Zoning Map or in other
circumstances not covered above, the Borough Zoning Hearing Board
shall interpret the location of the district boundary.
The regulations set by this chapter within each
district shall be the minimum regulations and shall apply universally
to each class or kind of structure or land, except as hereafter provided:
A. No building, structure, or land shall hereafter be
used or occupied and no building or structure or part thereof shall
hereafter be erected, constructed, reconstructed, moved or structurally
altered unless in conformity with the regulations herein specified
for the district in which it is located.
B. No building or other structure shall hereafter be
erected or altered:
(1) To exceed the maximum height specified for that zone.
(2) To accommodate or house a greater number of families
than specified for that zone.
(3) To occupy a greater percentage of the lot area than
specified for that zone.
(4) To have narrower or smaller rear yards, front yards,
side yards or other open space than herein required or in any other
manner be contrary to the provisions of this chapter.
C. No part of a yard or other open space or off-street
parking or loading space required about or in conjunction with any
building for the purpose of complying with this chapter shall be included
as part of a yard, open space, or off-street parking or loading space
similarly required for any other building.
D. No yard or lot existing at the time of passage of
this chapter shall be reduced in dimension or area below the minimum
requirements set froth herein. Yards or lots created after the effective
date of this chapter shall meet the regulations set forth in this
chapter.
E. All territory which may hereafter be annexed to the
Borough shall be considered to be zoned in the same manner as the
contiguous territory within the previous Borough limits until otherwise
classified.
