No person shall operate or conduct a pool or billiard hall or parlor without having first obtained from the Borough a license to do so and upon payment to the Borough of an annual license fee of $100 or $10 per pool table, whichever is greater. Such license shall expire on the 31st day of December of the year in which the same shall have been issued; provided, however, that the fee for any such license shall be prorated according to the effective date of the same. In the event that the licensee adds additional tables during any year, any additional fees shall be prorated.

Any person desiring to obtain such a license shall make application for the same in writing to the Borough Clerk. Said application shall set forth the location of the place for which the license is desired, the name and address and telephone number of the owner of the premises and, if the license is to be issued to a person other than the owner of the premises, the name, address and telephone number of such person and the name, address and telephone number of the manager or person who shall be in charge of the licensed premises. In addition, the license application shall disclose the name and address of any person having an ownership or other interest in the premises. No such license shall be issued by the Borough Clerk until after investigation and recommendation by the Chief of Police and approval by the Borough Council. The Police Chief, at his discretion, may require fingerprinting of all applicants.

A. 
The hours of operation of any pool or billiard hall shall be limited as follows:
(1) 
Sunday through Thursday: 9:00 a.m. to 11:00 p.m.
(2) 
Friday and Saturday: 9:00 a.m. through 12:00 midnight.
B. 
No licensee nor any agent, servant or employee of a licensee shall allow, suffer or permit or cause to be allowed, suffered or permitted:
(1) 
A minor under the age of 16 years, unaccompanied by an adult, to play in or at the licensed premises or to frequent or lounge or congregate or gather therein, and at any time when the Hopatcong Borough schools are open for classes.
(2) 
A minor age 16 or 17 years to play in or at the licensed premises or to frequent or lounge or congregate or gather therein during school hours when the Hopatcong Borough schools are open for classes, or after the hour of 9:30 p.m. unless accompanied by an adult.
(3) 
Any gambling in any form in or at the licensed premises.
(4) 
Any person under the age of 18 years to be employed in any capacity in or at the licensed premises.
(5) 
The possession, consumption or use of alcohol at any location at or on the premises.
(6) 
Any intoxicated or disorderly person to be admitted to the premises or to remain therein.
(7) 
The possession or use of any unlawful drug or narcotic, including marijuana, on or about the premises.
(8) 
Loud, unruly or disorderly conduct on or about the premises.
(9) 
Excessive noise or loud music to emerge from the premises.
Any license issued hereunder may be suspended by the Mayor whenever, in his judgment, it may be necessary for the furtherance of the decency and good order so to do, or the same may be revoked by the Borough Council upon a showing of good cause for its so doing. During such suspension or after any such licenses shall be revoked, the license shall be inoperative and of no effect.
Any person, firm or corporation who shall violate any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine of not more than $200 or to imprisonment in the county jail for not more than 90 days, or both such fine and imprisonment.
