As used in this chapter, the following terms
shall have the meanings indicated:
ALCOHOLIC BEVERAGE
Includes alcohol, spirits, liquor, wine, beer, cider and
every liquid or solid, patented or not, containing alcohol, spirits,
wine or beer and capable of being consumed by a human being.
PUBLIC PLACE
Any place to which the public or a substantial group of persons
has access, and includes but is not limited to highways, transportation
facilities, schools, places of amusement, parks, playgrounds, and
hallways, lobbies and other portions of apartment houses and hotels
not constituting rooms or apartments designed for actual residence.
This definition shall not include any place from time to time designated
by the Common Council for temporary special events, which designation
shall lapse upon completion of the event.

No person shall drink any alcoholic beverage in any public place not duly licensed to sell the same, within the area described and set forth in §
53-4 below, or in any moving, standing or parked vehicle in any public place within said area.
Possession of any open beverage container containing any alcoholic beverage by any person as described in the foregoing §
53-2 shall create the presumption that such person did drink or did intend to drink the contents thereof in violation of this chapter.

This chapter shall apply to the following area
situate within the City of Lockport: Beginning at the northeast corner
of the intersection of East Avenue and Washburn Streets; thence southerly
along the easternmost boundary of Washburn Street to the southeast
corner of the intersection of Washburn and Walnut Streets; then westerly
along the southernmost boundary of Walnut Street to the southwest
corner of the intersection of Walnut and South Transit Streets at
which point Walnut Street becomes West Genesee Street; thence westerly
along the southernmost boundary of West Genesee Street to the southwest
corner of the intersection of West Genesee and Hawley Street; thence
northerly along the westernmost boundary of Hawley Street to the northwest
corner of Hawley Street and Park Avenue; thence easterly along the
northernmost boundary of Park Avenue to the northwest corner of Park
Avenue and West Avenue at which point West Avenue becomes West Main
Street; thence easterly along the northernmost boundary of West Main
Street until it becomes Main Street; thence easterly along the northernmost
boundary of Main Street until it becomes East Avenue; thence easterly
along the northernmost boundary of East Avenue to the place of beginning.
All buildings, structures and individual parcels of real property
located within the aforesaid boundaries or immediately contiguous
thereto shall be included under the provisions of this chapter.
Every person who shall violate the provisions
of this chapter shall, upon conviction thereof, be punished by a fine
not to exceed $250 or by imprisonment not to exceed 15 days, or by
both such fine and imprisonment.
