Pursuant to the provisions of § 130,
Subdivision 17, of the Town Law of the State of New York, the Town
of Queensbury hereby regulates the operation of pleasure boats in
the waters within and bounding said Town, such regulation being necessitated
by the marked increase in pleasure boating in said waters and the
proportionate increase in dangers to others resulting therefrom.
As used in this article, the following terms
shall have the meanings indicated:
Includes any vessel propelled on water in any other manner
than by hand.
Includes both inboard and outboard engines using gasoline
or similar fuel.
Includes an individual, society, club, firm, partnership,
corporation or association of persons, and the singular number shall
include the plural number.
Embraces all water within the Town of Queensbury and all
waters bounding said Town to a distance of 1,500 feet.
No person shall operate on any water any boat
having a motor installed therein or attached thereto at a speed greater
than five miles per hour within 100 feet from any shore, unless such
vessel is being operated to bring water skiers to and from shore.[1]

No person shall anchor or moor any boat within
200 feet of any private property, except in the case of an emergency
or at the direction of any police officer or at the invitation of
the owner or lessee of said property and, further, other than for
the waters in Sandy Bay situate south of a straight line drawn from
the northernmost point of Ripley Point (Cleverdale) to the northernmost
point of Sheldon Point (Rockhurst), to which waters the following
exception is not applicable, an additional exception is made from
the provisions of this section when a boat is used for active engagement
in fishing. This section is applicable to Lake George waters only.

Any person violating any of the provisions of
this article shall be guilty of a violation, and any conviction thereof
shall be punishable by a fine not exceeding $250 or by imprisonment
in the Warren County Jail for not more than 15 days, or both.

No mechanically propelled vessel shall be operated
at a speed exceeding five miles per hour on the waters of Lake George
within the following described areas. The following areas are described
in accordance with a chart entitled "Lake George 1970 Base Chart prepared
for the State of New York Department of Conservation by Dickerson,
Czerwinski and Marneck."
A.
Sandy Bay: bounded on the east by the Rockhurst Peninsula,
on the south by the shore of Lake George between the Rockhurst and
Cleverdale Peninsulas, on the west by the Cleverdale Peninsula and
on the by a line which runs due east to due west between two points
identified as N 43.475644, W 73.41199 and N 43.475611, W 73.635924
and is 1,800 feet north of the southernmost point on the southern
boundary of the area, which area is designated as a "restricted use
zone" pursuant to 6 NYCRR 646-2.9(b)(1).

B.
Warner Bay: bounded northerly by a line 1,500 feet
north of the south shore of Lake George in Warner Bay, easterly by
the shore of Lake George, southerly by the south line of Lake George
in Warner Bay and Route 9L and westerly by the shore of Lake George.

C.
Assembly Point, Speaker Heck Island: bounded northerly
by the south line of Town of Bolton, easterly by a line which is a
projection south of the east division line between the Town of Bolton
and Town of Queensbury, southerly by a line parallel with the northerly
line and 600 feet south thereof as measured at right angles, westerly
by the east line of Speaker Heck Island and east line of Long Island.
D.
Harris Bay: bounded northwesterly by a line between
the U8 obstruction buoy and black can buoy west of Happy Family Islands
and bounded on the remaining sides by lines drawn between the U8 and
the black can buoy to the nearest point on the shoreline and by the
shoreline of Harris Bay.
E.
Dunhams Bay: all the waters of Dunhams Bay lying southerly
of a point beginning at the northwest corner of the lands of Barrie
and Mark Handelman, being also the northwest corner of Tax Map Parcel
239.15-1-12; thence running north 54 degrees, 25 minutes and 28 seconds
east, crossing said Dunhams Bay a distance of 1,464.00 feet more or
less to a point in the easterly shore of Dunhams Bay at the northwest
corner of the lands of Suzanne Mastro being Tax Map Parcel 239.16-1-23;
thence running southerly, westerly and then northerly again along
the shore of said Dunhams Bay, a distance of 8,192.00 feet more or
less to the point and place of beginning, containing 68.3 acres of
water to be the same more or less.

F.
Unnamed bay off Warner Bay: beginning at a point in
the southerly shore of Lake George at the most northerly tip of land
owned by David Vrooman Jr., and Joan Taylor, being some 760.00 feet
more or less northerly of the northwest end of Westmore Road and also
identified as 43 degrees, 28.37 minutes North latitude and 73 degrees,
37.77 minutes West longitude; running thence in a northerly direction
crossing said lake, some 805.00 feet more or less to a point in the
southerly shore of said Lake George on the westerly bounds of lands
of Susan Weber and further identified as 43.00 degrees, 28.50 minutes
North latitude and 73.00 degrees, 37.50 minutes West longitude; thence
running easterly, southerly, westerly, northerly, northwesterly, northerly
and northwesterly again along the shore as it winds and turns, to
the point and place of beginning.

An offense against any provision of this article
is hereby declared to be a violation punishable by a fine not exceeding
$250 or by imprisonment for a term not exceeding 15 days, or by both
such fine and imprisonment.
