It is hereby determined by the Town Board of
the Town of Queensbury, Warren County, New York, that the existing
Town dump is adequate in size to provide for the disposal of rubbish
of residents or taxpayers of the Town of Queensbury and City of Glens
Falls but is not adequate for the disposal of rubbish from areas outside
of the Town of Queensbury and City of Glens Falls and that, for the
protection of residents of the Town of Queensbury, the use of the
dump must be restricted to residents and taxpayers of the Town of
Queensbury and City of Glens Falls. It is further determined that,
to protect the persons and property of residents in the area of the
dump, it is necessary to prevent fires and to control rodents at the
dump and, to accomplish this purpose, that the dump be placed under
the direct supervision of the Landfill Superintendent and that the
use of the dump by rubbish collectors be controlled.
As used in this article, the following terms
shall have the meanings indicated:
RESIDENTS
Persons who live in the Town of Queensbury and City of Glens
Falls, whether or not they are the owners of real property.

RUBBISH COLLECTOR
A person, firm or corporation engaged in the business of
picking up rubbish at homes and places of business and hauling the
same by truck or other conveyance to the Town dump.
TAXPAYERS
Persons, firms or corporations who or which own real property
in the Town of Queensbury and City of Glens Falls on which taxes are
paid to the Town of Queensbury or City of Glens Falls, whether or
not such person or any partner of a firm or officer, director or stockholder
of a corporation actually lives in the Town of Queensbury or City
of Glens Falls.

The Town dump shall be under the control of
the Town Landfill Superintendent, and no person entitled to use the
Town dump shall place or dispose of rubbish at the Town dump except
in the places designated by the Town Landfill Superintendent and in
the manner required by the Town Landfill Superintendent or his duly
authorized employees. Any person who shall refuse to comply with the
directions of the Town Landfill Superintendent or his duly authorized
employees relating to the places and manner of disposal of rubbish
at the Town dump shall be deprived of the right to dispose of rubbish
at the Town dump.

A. No person engaged in the business of collection of
rubbish shall dispose of rubbish at the Town dump except rubbish collected
in the Town of Queensbury and City of Glens Falls, and all trucks
or vehicles used to transport rubbish shall be covered by a tarpaulin
or other secure cover to prevent littering. Those persons engaged
in the business of collecting and disposing of cesspool contents and
sewage shall transport said material in a watertight container equipped
with drainage hoses and, when using the Town dump, will dispose of
said material only in exact locations designated by the attendant
on duty.
B. No person licensed as a commercial hauler shall use
the Town dump on Sundays unless prior authorization is received from
the Landfill Superintendent.

A. No person shall collect rubbish and sewage in the
Town of Queensbury or City of Glens Falls for disposal at the Town
dump unless such person shall possess a license issued by the Town
Clerk which shall be valid for the calendar year for which such license
is issued.
B. The annual license fee for commercial haulers shall
be $100 per truck and further amendments to the annual fees for such
license shall be established by the Town Board of the Town of Queensbury
by resolution following a public hearing thereon after notice of the
same in the official Town newspaper, which notice shall also indicate
the proposed fees.
C. These fees shall be paid to the Town Clerk at the
time the license is issued. The Town Clerk shall also issue to the
person so licensed a yearly license.
D. The City of Glens Falls shall be relieved from the
payment of the above-referenced fees, and only vehicles owned and
operated by said city shall be allowed to dump at the landfill without
payment of the required fee.

A. Notwithstanding anything to the contrary set forth
herein, the provisions of this article which restrict or limit disposal
of solid waste at the Town of Queensbury Ridge Road Landfill to that
solid waste originating from residents, businesses or other sources
within the boundaries of the Town of Queensbury or the City of Glens
Falls or outside the Town of Queensbury but within the County of Warren
under circumstances involving the use of the landfill as a temporary
consolidated landfill shall not be applicable to solid waste originating
outside of the Town of Queensbury and/or the County of Warren which
is classified or known as "construction and demolition debris," as
defined by the Department of Environmental Conservation regulations,
paper sludge and/or Adirondack Resource Recovery Facility ash which
will be subsequently processed into Rolite; brought into the Town
of Queensbury for the purpose of disposition at said Town of Queensbury
Landfill for grading, filling and leveling the landfill and for uses
as gas venting material or barrier protection material purposes; and
brought into or disposed of at said landfill in accordance with a
written agreement and upon such payment or consideration and other
terms or provisions as shall be approved by the Town Board of the
Town of Queensbury as demonstrated by the adoption of an authorizing
resolution adopted by majority vote.
B. In accordance with the provisions of Subsection
A hereof, the Town Board of the Town of Queensbury may arrange for acceptance and disposal of paper mill sludge; ash from the Adirondack Resource Recovery Facility, which will be subsequently processed into Rolite; and/or construction and demolition debris, as defined by Department of Environmental Conservation regulations, all materials originating or being allowed to originate from outside the Town of Queensbury and the County of Warren.

A. A rubbish collector collecting rubbish in the Town
of Queensbury or City of Glens Falls for disposal at the Town dump
without a license as provided by this article shall be, upon conviction,
guilty of a misdemeanor, and any person convicted of a violation of
this article shall be subject to a fine not exceeding $1,000 or to
imprisonment in the county jail for a term not exceeding one year,
or both such fine and imprisonment.
B. Any person who shall be licensed to collect rubbish
for disposal in the Town dump and who shall bring to the Town dump
for disposal rubbish collected outside of the Town of Queensbury or
City of Glens Falls, shall be subject to the penalty of the revocation
of his license for the year to which the same was issued. Licenses
shall be revoked for cause by resolution adopted by a majority vote
of the Town Board.
