This article shall be known as the "Solid Waste
Source Limitation Law of the Town of Queensbury."
The Town Board of the Town of Queensbury finds
that it is in the general public interest to place limitations on
the source of solid waste disposed at the Queensbury sanitary landfill.
It is the intention of the Town Board to minimize and limit the amount
of land utilized for solid waste disposal and therefore reduce the
impacts on the environment, decrease the cost for closure of the sanitary
landfill and maximize the existing facility for the benefit of the
residents of the Town of Queensbury.
No person, firm or corporation shall dispose,
leave or cause to be placed at the Town of Queensbury sanitary landfill
on Ridge Road in said Town or the Luzerne Road transfer station garbage
or any form of solid waste regulated by the New York State Department
of Environmental Conservation, which garbage or solid waste originates
outside of the boundaries of the Town of Queensbury.
Section
96-19 above shall not apply to garbage or solid waste originating within the boundaries of the City of Glens Falls.

A. The provisions of this article which restrict or limit
disposal of solid waste at the Town of Queensbury Ridge Road landfill
to that solid waste originating from residents, businesses or other
sources within the boundaries of the Town of Queensbury shall not
be applicable in the event that:
(1) The Town of Queensbury Ridge Road landfill is authorized
by the Department of Environmental Conservation to temporarily serve
as the consolidated landfill for all Towns located in the County of
Warren.
(2) Recycling programs are implemented by the Town of
Queensbury.
(3) Landfill user agreements are entered into among the
Town of Queensbury and all Towns using the landfill concerning, among
other things, the mandatory requirement that recycling measures be
taken to limit the amount of waste disposed of at the Town of Queensbury
landfill.
B. In this event, no person, firm or corporation or other
business entity shall be fined or in any fashion penalized for the
disposal of solid waste at said Town of Queensbury landfill originating
from within the County of Warren. Also, in such event, no person,
firm or corporation shall dispose, leave or cause to be placed at
the Town of Queensbury sanitary landfill on Ridge Road garbage or
any form of solid waste regulated by the New York State Department
of Environmental Conservation, which garbage or solid waste originates
outside the boundaries of the County of Warren.

A. Notwithstanding anything to the contrary set forth
herein, the provisions of this article which restrict or limit disposal
of solid waste at the Town of Queensbury Ridge Road Landfill to that
solid waste originating from residents, businesses or other sources
within the boundaries of the Town of Queensbury or the City of Glens
Falls or outside the Town of Queensbury but within the County of Warren
under circumstances involving the use of the landfill as a temporary
consolidated landfill shall not be applicable to solid waste originating
outside of the Town of Queensbury and/or the County of Warren which
is classified or known as "construction and demolition debris," as
defined by the Department of Environmental Conservation regulations,
paper sludge and/or Adirondack Resource Recovery Facility ash which
will be subsequently processed into Rolite; brought into the Town
of Queensbury for the purpose of disposition at said Town of Queensbury
Landfill for grading, filling and leveling the landfill and for uses
as gas venting material or barrier protection material purposes; and
brought into or disposed of at said landfill in accordance with a
written agreement and upon such payment or consideration and other
terms or provisions as shall be approved by the Town Board of the
Town of Queensbury as demonstrated by the adoption of an authorizing
resolution adopted by majority vote.
B. In accordance with the provisions of Subsection
A hereof, the Town Board of the Town of Queensbury may arrange for acceptance and disposal of paper mill sludge; ash from the Adirondack Resource Recovery Facility, which will be subsequently processed into Rolite; and/or construction and demolition debris, as defined by Department of Environmental Conservation regulations, all materials originating or being allowed to originate from outside the Town of Queensbury and the County of Warren.
