No unauthorized person(s) shall uncover, make any connections with or openings into, use, alter or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Town.
A. 
Two classes of building sewer permits will be issued. These will be for residential/commercial and industrial use (see Article XI for additional industrial requirements). The owner or his agent shall make application on a special form furnished by the sewer district. The permit shall be supplemented by any plans, specifications or other information considered pertinent in the judgment of the Sewer Inspector.
B. 
A permit and inspection fee for a residential/commercial use will be required, except for initial hookups of existing structures within the time schedule allowed in § 136-44, measured from the completion date of the construction contract of the public sewer servicing the structure. Such fee shall be detailed, from time to time, by Town Board resolution and included in the Town's Wastewater Department fee schedule. The cost of an industrial permit shall be negotiated with the Town of Queensbury at the time of application. This will depend on the volume of sewage, number and size of connections and quality of discharge.

A. 
All costs and expenses incidental to the installation and connection of the building sewer shall be borne by the owner(s). The owner(s) shall indemnify the sewer district and the Town from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.
B. 
All costs and expenses incidental to the cleaning and maintenance of the building sewer lateral from the main into the building shall be borne by the property owner. The owner shall indemnify the sewer district and the Town from any loss or damage that may directly or indirectly be occasioned by the cleaning and/or other maintenance of the building sewer lateral.

Where a new building is constructed and there is no Town service lateral from the main to the property line, the installation of this lateral and the tapping of the main will be the responsibility of the property owner. The cost of this work, including excavation, pipe work, backfill, replacement of pavement, etc., will be paid by the property owner. The property owner or contractor must provide plans and specifications to the Town Wastewater Department for approval prior to any site disturbance. Once the plans are approved, the property owner or contractor must obtain all required permits, including any permits needed for construction within a public right-of-way or under a public road. Construction must be scheduled in consultation with the Wastewater Department so that a Town representative can be present during construction. No actual connection to the Town's sewer system may be made until the Wastewater Director has issued a permit to connect.

A. 
A separate and independent building sewer shall be provided for every building, except that where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, easement, courtyard or driveway, the front building sewer may be extended to the rear building and the whole considered as one building sewer. The Town does not, and will not, assume any obligation or responsibility for damage caused by or resulting from the use of any single connection aforementioned.
B. 
Notwithstanding the above, the Wastewater Director may waive the requirement for separate building sewers upon application by the property owner and determination in the Director's sole discretion that the Town's wastewater system will not be adversely affected. Any application for waiver must include a formal agreement between the parties proposing to use the shared sewer connection. The agreement must include provisions relating to how responsibilities for the shared lines and costs will be allocated between the parties. Any agreement related to allocation of costs will not affect the Town Board's right to establish rates. Approval of the agreement must be received from both Town Counsel and the Wastewater Director prior to any such waiver. Such agreement must be recorded in the Warren County Clerk's office referencing the entire property(ies) and a copy provided to the Town Wastewater Department as the final requirement for receiving a valid waiver.
The size, slope, alignment, materials and construction of a building sewer and the methods to be used in excavating, placing of the pipe, joining, testing and backfilling the trench shall all conform to the requirements of this Part 3, plus the latest revisions of the Building and Plumbing Code or other applicable rules and regulations, if any, of the Town of Queensbury.[1]

Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, sanitary sewage carried by such building drain shall be lifted by an approved means and discharged to the building sewer.
No person(s) shall make connection of roof downspouts, foundation drains, sump pumps for foundation or subsurface water drainage, areaway drains or other sources of surface runoff or groundwater to a building sewer or building drain which in turn is connected, directly or indirectly, to a public sanitary sewer.
The connection of the building sewer into a public sewer shall conform to the requirements of this Part 3 and the latest revisions of the Building and Plumbing Code[1] or other applicable rules and regulations of the Town of Queensbury, if any, and the connections shall be made gastight and watertight and verified by proper testing at the owner's expense.

The applicant for the building sewer permit shall notify the Town Sewer Inspector when the building sewer is ready for inspection and connection to the public sewer. The connection and testing shall be made under the supervision of the Town Sewer Inspector or his representative.
All excavations for building sewer installations shall be adequate so as to protect the public from hazard. Streets, sidewalks, parkways and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Town of Queensbury.
The property owner's sewer connection between the Town service lateral at the property line and the building shall be a direct connection. The building sewer may pass through an existing septic tank. Sides of concrete tanks shall be cut out at least twice the diameter of pipe to be installed through the tank. The tank shall be filled with gravel or pea stone and compacted. Metal tanks shall be collapsed and backfilled with compacted gravel or pea stone. The building sewer shall bypass all leach pits, tile fields and other private disposal facilities.
In sewer district areas where sanitary sewers drain to a wastewater pumping station, an approved backwater valve shall be installed in all buildings subject to flooding during a failure of the pumping facilities. The location of said backwater valve shall be as indicated on the drawing for a typical house connection or as directed by the Town Sewer Inspector.
