The City of Coatesville hereby adopts, for the purpose of prescribing
regulations governing the safe installation and maintenance of all mechanical
equipment, the mechanical codes known as the "International Mechanical Code,"
2000 Edition; "International Fuel Gas Code," 2000 Edition, and "International
Energy Conservation Code," 2000 Edition, as published by the International
Code Council, Inc., save and except such portions as are hereinafter deleted,
modified or amended, of which three copies have been and now are filed in
the office of the Codes Department and the same are hereby adopted and incorporated
as fully as if set out at length herein. From the date on which this chapter
shall take effect, the provisions thereof shall be controlling within the
corporate limits of the City of Coatesville.
The Mechanical Code hereby adopted is amended as follows:
A. Section 101.1, Title, is amended to read as follows:

Section 101.1. Title. These regulations shall be known
as the "Mechanical Code of the City of Coatesville," hereinafter referred
to as "this code."

B. Section 106.5, Periodic Inspections, is amended to read
as follows:

Section 106.5. Periodic Inspections. The fees for all periodic inspections shall be as established, from time to time, by the City Council as set forth in Chapter 108 of the City Code.

C. Section 106.5.2, Fee Schedule, is amended to read as
follows:

Section 106.5.2. Fee schedule. The fees for all mechanical work shall be as provided, from time to time, by the City Council as set forth in Chapter 108 of the City Code.

D. Section 108.4, Violation penalties, is amended to read
as follows:

Section 108.4. Violation penalties. Any person who shall
violate a provisions of this code or shall fail to comply with any of the
requirements hereof or who shall erect, construct, alter or repair mechanical
equipment or systems in violation of the approved construction documents or
directive of the Code Enforcement Officer, or of a permit or certificate issued
under the provisions of this code shall be, upon conviction, sentenced to
a fine of not more than $1,000 plus costs or to a term of imprisonment not
to exceed 90 days, or both such fine and imprisonment. Each day that a violation
continues after notice has been served shall be deemed a separate offense.

E. Section M-117.2, Unlawful Continuance, is amended to
read as follows:

Section M-117.2. Unlawful Continuance. Any person who shall
continue any work in or about the structure after having been served with
a stop-work order, except such work as that person is directed to perform
to remove a violation or unsafe condition, shall be, upon conviction, sentenced
to a fine of not more than $1,000 plus costs and, in default of payment of
said fine and costs, to a term of imprisonment not to exceed 30 days.

In all matters that are regulated by the law of the Commonwealth of
Pennsylvania or by regulations of departments or agencies of the commonwealth
promulgated by authority of law, such laws or regulations, or other ordinances
of the City of Coatesville, as the case may be, shall control where the requirements
thereof are the same as or in excess of the provisions of this chapter. The
code shall control in all cases where the state requirements, or the requirements
of other ordinances of this city, are not as strict as those contained in
this chapter.
The provisions of this chapter so far as they are the same as those
of ordinances and/or codes in force immediately prior to the enactment of
this chapter, are intended as a continuation of such ordinances and codes
and not as new enactment. The provisions of this chapter shall not affect
any act done or liability incurred, nor shall they affect any suit or prosecution
pending or to be instituted to enforce any right or penalty or to punish any
offense under the authority of any of the repealed ordinances.
