As used in this article, the following terms shall have the meanings indicated:
PEDALCYCLE
A vehicle propelled solely by human-powered pedals pursuant to Section 102 of the Pennsylvania Vehicle Code.

A. 
A pedalcycle shall be operated only on the roadway as near to the right-hand side as possible. Pedalcycles whose wheel diameter is 16 inches or over shall not be operated on the sidewalks. (See Section 3505 of the Pennsylvania Vehicle Code.)
B. 
The operator of a pedalcycle shall obey all official traffic signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. [See Section 3501(a) of the Pennsylvania Vehicle Code.]
C. 
The operator of a pedalcycle emerging from a driveway or building shall yield the right-of-way to all pedestrians on the sidewalk and to all vehicles on the roadway. [See Sections 3501(a), 3344 and 3547 of the Pennsylvania Vehicle Code.]
D. 
The operator of a pedalcycle shall not carry any other person upon the handlebar, frame or any part of the pedalcycle. This provision shall not be construed to prohibit the use of pedalcycles built to be operated by two or more persons. [See Section 3504(a) and (b) of the Pennsylvania Vehicle Code.]
E. 
The operator of a pedalcycle shall not indulge in any abnormal or trick riding, and shall keep at least one hand on the handlebar at all times while in use. [See Sections 3501(a), 3506 and 3714 of the Pennsylvania Vehicle Code.]
F. 
Operators of pedalcycles shall not ride in any manner other than single file except on paths or parts of the roadway set aside for the exclusive use of pedalcycles. [See Section 3505(c) and (d) of the Pennsylvania Vehicle Code.]
G. 
Operators of pedalcycles shall not hitch onto vehicles or buses upon a roadway.
H. 
The operator of a pedalcycle shall park the pedalcycle upon the roadway at the curb, upon the sidewalk in a rack to support the pedalcycle or against a building, except windows or glass doors thereof, in such a manner as to afford the least obstruction to pedestrians or vehicular traffic. [See Section 3509(a) and (b) of the Pennsylvania Vehicle Code.]

Any person convicted in a summary conviction before a Magisterial District Judge of a violation of any provision of this article shall be subject to the following penalties:
A. 
Impounding of the pedalcycle for not more than seven days for the first violation; impounding of the pedalcycle for not more than 14 days for the second violation; and impounding of the pedalcycle for not more than 30 days for the third violation.
B. 
A fine of not more than $10.

The following words and phrases, when used in this article, shall have the following meanings pursuant to Section 102 of the Pennsylvania Vehicle Code:
MOTORCYCLE
Every motor vehicle having a saddle for the use of riders and designed to travel on not more than three wheels in contact with the ground, bicycles with motor attached, and scooters with motor attached.
STREET or HIGHWAY
Every way or place of whatever nature open to the use of the public as a matter of right for purposes of vehicular travel. "Street" or "highway" do not include a roadway or driveway upon grounds owned by private persons, colleges, universities or other institutions.

A person operating a motorcycle shall ride only upon the permanent and regular seat attached to the motorcycle, and the operator shall not carry any other person nor shall any other person ride on a motorcycle unless the motorcycle is designed to carry more than one person, in which event a passenger may ride upon the permanent and regular seat if designed for two persons or upon another seat firmly attached to the motorcycle at the rear or side of the operator. In no event shall a passenger sit in front of the operator of the motorcycle.
A. 
No person shall operate a motorcycle unless it is equipped with a muffler in good working order and in constant operation.
B. 
No person shall operate a motorcycle that has a muffler cutout or a bypass in a muffler.
C. 
No person shall operate a motorcycle equipped with a muffler from which the muffler plates, screens or other original internal parts have been removed or a vehicle that has been equipped with an exhaust system which has been modified in a manner which will amplify or increase the noise emitted by the motor.

The annual fee for a license for the letting and rental of motorcycles, plus the annual fee for each motorcycle for hire to the public, are included in Chapter 285, Fees. Additional motorcycles may be licensed during the year on a pro rata basis, provided that no such license shall be for less than 50% of the annual charge. Each application shall contain the type of motorcycle, horsepower thereof, factory and state license numbers and seating capacity.
No person shall let, rent or furnish any motorcycle to any person under the age of 18 years unless such person shall furnish and leave with the licensee a statement in writing showing the consent of the parent or guardian to the leasing or letting of the motorcycle to such person. All records required by this section shall be kept for a period of not less than one year and shall at all times be open to inspection by the Bureau of Police.
No licensee shall let or furnish any motorcycle to any person not having his motorcycle driver's license issued in accordance with the provisions of the laws of Pennsylvania. No person, whether he is the owner or lessee of a motorcycle, shall permit any person who is not licensed by Pennsylvania to drive or operate such motorcycle. Before letting, leasing or furnishing any motorcycle to any person, the licensee shall make a permanent and legible record containing the name, address and age of the person to whom the motorcycle is leased, rented or let and shall record thereon the number and date of issue and expiration of the driver's license, together with the description of the person as shown by the driver's license, and identify the motorcycle leased or rented to the person by the motorcycle license number issued by Pennsylvania, together with the date or dates of such licensing.
Any person violating any of the provisions of this article shall be fined not more than $300 and, in default of payment thereof, imprisoned not more than 90 days.
